Efraín Ríos Montt to Stand Trial for Genocide

Last night, Judge Carol Patricia Flores ruled that there was sufficient evidence to formally charge former dictator Efraín Ríos Montt with genocide. The U.S.-supported dictator ruled Guatemala in 1982 and 1983, while the military carried out a scorched earth policy at the height of the 36-year internal armed conflict. Although this particular charge addresses massacres carried out in the Maya Ixil region, massacres were carried out throughout Guatemala and over 80% of the war's victims were indigenous Maya.

"We can establish these are acts so degrading, so humiliating that there is no justification," the judge said after detailing the human rights abuses from survivors' testimonies. In her decision, the judge clearly stated that the extermination of the civilian population was the result of military plans, and that these plans were executed under the command of Ríos Montt.

As the judge read the decision, family members, activists and supporters gathered outside the court applauded, hugged and lit firecrackers to celebrate. Yesterday represented a huge symbolic and concrete step forward in the struggle against impunity for past and current crimes in Guatemala.

Impunity - Neither yesterday, nor today.

Ríos Montt posted bail and will be held under house arrest until his next trial date. The Association for Justice and Reconciliation (AJR) and the Center for Human Rights Legal Action (CALDH) will be busy in the upcoming months preparing for trials against Ríos Montt and other members of his high command already facing genocide charges.

"We are trying to achieve justice so that our children never experience these massacres. We ask the international community to be on alert and to support us in the struggle," the president of the AJR said yesterday outside the court.

We are honored to have shared this historic moment and to have accompanied the survivors, their families and their legal advocates in this process for so many years. We hope the courts will continue to proceed in accordance with international and national laws.

Ríos Montt Linked to Genocide Process

Statement from CALDH and AJR

The Court has restored hope to Guatemalan society, which has waited nearly 30 years for the atrocities committed against the Mayan people to be recognized. In an historic and momentous act for thousands of victims, Judge Carol Patricia Flores linked General José Efraín Ríos Montt, who functioned as head of state and one of the authors of the genocide, to the legal process. The members of the military high command in 1982 and 1983 are being held accountable, something that had seemed impossible, but today is a reality in Guatemala.

We applaud without hesitation the judge’s decision to incorporate Ríos Montt in the trial for genocide and crimes against humanity. However, we express our discontent with the house arrest authorized for him, due to the serious nature of his crimes that are of national and international significance. This decision is also inconsistent, as the other two former members of the military accused of the same crimes are in preventative detention.

These facts show us that although there are judges and judicial officials who act according to the law, structures of power and impunity that favor certain sectors remain embedded within the country’s justice system. The Public Prosecutor detailed to the judge the elements of genocide and planning in which the accused participated - the same acts which were acknowledged by the judge and taken into consideration in the decision. Likewise, the Public Prosecutor justified the application of appropriate coercive measures for the accused, but this line of reasoning was rejected.

In 2001, surviving victims of the genocide filed a legal action against the military high command of 1982-83, comprised of the Head of State, Efraín Ríos Montt, the Minister of Defense, General Oscar Humberto Mejía Víctores, and General Héctor Mario López Fuentes. After almost 10 years of knocking on the doors of justice, the Public Prosecutor requested the first statement from Ríos Montt, linking him to the process.

These processes are a historic opportunity for the Guatemalan justice system to break with impunity, and to show the entire world that we are a country that complies with its law and with international human rights norms. Justice is the cornerstone that guarantees the non-repetition of violence. Therein lies the urgent necessity to apply it, for both the crimes of the past and the present.

The judge set a deadline of two months for the Public Prosecutor to present the indictment, after which a public hearing will be held to decide whether the case merits a public trial. We hope that the rest of the process will continue in accordance with the law; that the system of justice will not be unresponsive because of the significance of this case; and that it will not become complicit to delaying actions and obstructions that have characterized the strategy of the accused in other related cases.

On such a special day - marked on the sacred Mayan calendar by /Doce Tz´i´,/ which symbolizes justice, authority, the guardian of material and spiritual law - Guatemala takes a step forward in a landmark case for the country. We ask that the State respond in accordance with the law and the demands of justice. The State has a debt to the victims and survivors of the internal armed conflict.

TRUTH AND JUSTICE ARE THE ONLY ROAD TO RECONCILIATION.

Ríos Montt ligado a proceso por genocidio

La Justicia le devuelve la esperanza a la sociedad guatemalteca que tuvo que esperar casi 30 años para que se conocieran las atrocidades cometidas en contra del pueblo maya. En un hecho histórico y trascendental para las miles de víctimas, la Jueza Carol Patricia Flores dejó ligado a proceso a uno de los autores del genocidio, el general José Efraín Ríos Montt quien fungió como jefe de estado. Los miembros del alto mando militar de los años 82 y 83 se encuentran rindiendo cuentas a la justicia, escenario que se creía imposible, pero que hoy en Guatemala es una realidad.

Apreciamos positivamente la decisión de la jueza de ligarlo a proceso por genocidio y delitos contra deberes de la humanidad, sin embargo manifestamos nuestra inconformidad por la medida sustitutiva de arresto domiciliario otorgada a Ríos Montt ya que los delitos por los que se le imputó son graves y de gran trascendencia nacional e internacional. Asimismo, había ya un precedente de prisión preventiva para otros dos militares acusados por los mismos delitos, por lo que consideramos incoherente dicha medida.

Estos hechos nos demuestran que aunque hayan jueces y operadores de justicia que actúan apegado a derecho, todavía persisten en el país estructuras de poder e impunidad incrustadas en el sistema de justicia que pretenden favorecer a ciertos sectores. El Ministerio Público explicó a la jueza los elementos del genocidio por los que se considera que el imputado tuvo participación en la planificación de cada uno de los hechos mismos que fueron recogidos por la juzgadora y tomados en cuenta para la decisión. De igual forma el MP fundamentó en torno a la medida de coerción apropiada para el imputado, sin embargo estos fundamentos fueron rechazados.

En el año 2001, las víctimas sobrevivientes del genocidio interpusieron una querella contra el alto mando militar de 1982-1983 integrado por el Jefe de Estado, Efraín Ríos Montt, el Ministro de la Defensa General, Oscar Humberto Mejía Víctores y el General Héctor Mario López Fuentes. Después de casi diez años de haber tocado las puertas de la justicia, el Ministerio Público solicita la primera declaración de Ríos Montt quedando ligado a proceso.

Estos procesos son una oportunidad histórica para el sistema de justicia guatemalteco que puede romper con la impunidad y demostrarle al mundo entero que somos un país que cumple con su legislación y la normativa internacional en materia de derechos humanos. La justicia es el pilar fundamental que garantiza la no repetición de los hechos violentos. Ahí radica la urgente necesidad de aplicarla, para los crímenes del pasado y el presente.

La jueza fijó un plazo de dos meses para que el Ministerio Público presente la acusación y luego de esta acción se realice la audiencia pública para decidir si amerita un debate oral y público. Esperamos que el resto del proceso continúe con actuaciones apegadas a derecho, que el sistema de justicia no sea indiferente ante la trascendencia de este caso y no se convierta en cómplice de acciones dilatorias y de obstrucción que han sido la estrategia del imputado en otros casos en los que se le ha relacionado.

En un día tan especial, en el que el calendario sagrado Maya nos marca el Doce Tz´i´ que simboliza la Justicia, la autoridad, el guardián de la ley material y espiritual, Guatemala dio un paso adelante en un caso emblemático para el país, demandamos que el Estado responda apegado a derecho a la solicitud de justicia. El Estado tiene esa deuda con las víctimas y sobrevivientes del conflicto armado interno.

Former General Otto Pérez Molina’s First Days in Office

On January 14, former General Otto Pérez Molina assumed office as the next president of Guatemala, promising change. Pérez Molina has sworn that his administration will produce results within 6 months by implementing new iron-fist measures to curb soaring violence and organized crime.

Pérez Molina's administration's first acts include removing the indigenous peoples' flag from the National Palace, citing that the flag represents division, and implementing a number of policies that will further militarize the state. Police-military task forces were almost immediately formed to combat extortions, murders, robbery, femicides and kidnappings, military patrols were deployed throughout the country and Pérez Molina has stated that he will seek the full re-instatement of U.S. military aid, restricted for decades due to the Guatemalan military's involvement in brutal human rights violations during the war.

The Patriot Party's governance plan is full of language reminiscent of military plans of the 1980s and in his inauguration speech Pérez Molina alluded to groups that refuse to let go of the past, but "rather appear to making a living off of it and continue to receive international support in some cases." Human rights groups have long expressed concern about how this administration will respond to cases seeking justice for crimes committed during the war.

Pérez Molina has also vowed to stimulate rural development by creating a new ministry, passing a rural development law proposed by a coalition of campesino groups, expanding the electrical grid and mining licenses, and raising royalties for mining companies. The Guatemalan press reported that Canadian mining giant Goldcorp has negotiated an increase in royalties from 1% to 3%. The CEO of Goldcorp is among Canada's 100 wealthiest CEOs.

Right-wing technocrats and military intelligence officials dominate Pérez Molina’s cabinet. It remains to be seen how the emerging security apparatus and those in charge of implementing development plans will respond to social movements, land occupations and human rights defenders that challenge the administration in any way.

Genocide cases: Ríos Montt to Testify, Mejía Victores Unfit for Trial

Efraín Ríos Montt, the U.S.-supported dictator who ruled at the height of Guatemala's civil war, has been called to testify in the genocide case on January 26. As of January 14th, Ríos Montt stepped down from his position in the Guatemalan Congress and no longer can argue congressional immunity for charges against him.

Regardless of the outcome of the hearing tomorrow, the fact that the former general has been called to testify represents a huge step forward for the survivors and legal advocates that have tirelessly worked this case for 11 years.

In mid-December Ríos Montt and his lawyers visited the offices of the Public Prosecutor's Office to ask for information regarding investigations against him, declaring that he is in good health and has no intention of evading charges. "There is a list of those accused of genocide and my name is on it," he said, "I don't want my arrest to be a spectacle, like in a movie, I will appear in court if I am cited."

On January 27th, the First Court for High Risk Crimes is set to determine whether Ríos Montt will face charges in the national genocide case brought by the Association for Justice and Reconciliation (AJR) and the Center for Human Rights Legal Action (CALDH). The Rigoberta Menchú Tum Foundation has called for Ríos Montt's arrest to face charges in the international genocide case under investigation by the Spanish courts. Ríos Montt is the subject of an outstanding international arrest warrant issued by Interpol.

In a hearing on January 5th, Judge Carol Patricia Flores declared the suspension of legal proceedings against former head of state Oscar Humberto Mejía Victores, accused of responsibility for genocide and crimes against humanity committed by the Guatemalan military during his tenure as Minister of Defense for the Ríos Montt regime. Both state-appointed and independent medical experts have found that Mejía Victores is unable to speak due to a stroke; Judge Flores ordered that his health be examined every 30 days, with the case to be re-opened if his health improves. The Court had previously ruled to allow Mejía Victores to be detained under house arrest rather than at the Military Hospital in Guatemala City.

José Mauricio Rodríguez Sánchez, director of the "D2" military intelligence branch under Ríos Montt, was expected to stand trial for genocide and crimes against humanity starting January 31st, however his trial is likely to be delayed due to injunctions filed by his lawyers. Similarly, the process against Hector Mario López Fuentes, Army Chief of Staff under Ríos Montt, is stalled pending the resolution of an appeal filed by the AJR and CALDH to reinstate Judge Carol Patricia Flores.

2011: El año más violento contra defensores y defensoras de derechos humanos

2011: EL AÑO MÁS VIOLENTO CONTRA DEFENSORES Y DEFESORAS DE DERECHOS HUMANOS

La Unidad de Protección a Defensoras y Defensores de Derechos Humanos – Guatemala (UDEFEGUA), informa, que según nuestros registros, el año 2011, fue el año más violento en contra de defensores y defensoras de derechos humanos. Contabilizamos un total de 402 hechos, que representan violaciones de derechos humanos por el derecho a defender derechos. Las agresiones fueron cometidas en contra de 94 defensoras de derechos humanos lo que representa el 23% de casos, 293 defensores correspondientes al 73% de los registros, y el 4% fueron orientados en contra de instituciones. En relación con el año 2010 se evidencia un aumento en el número de casos registrados de un 33%.

Durante el gobierno de Álvaro Colom se registraron 1224 agresiones y eso contrasta con las 618 del gobierno de Oscar Berger y las 338 del gobierno de Alfonso Portillo. El agravamiento de la situación de defensores y defensoras de derechos humanos está directamente relacionado a la ausencia de atención a los conflictos de tierra y la política represiva en contra de las comunidades que objetan el uso de sus recursos sin consulta previa. El mal manejo de la
conflictividad social llevo al gobierno de Colom a utilizar los Estados de excepción como mecanismo de control social, agravando la situación de los defensores y defensoras de derechos humanos en la región.

Durante el 2011, el gobierno de Álvaro Colom retomó la práctica de la difamación a los defensores y defensoras de derechos humanos y con ello se abrió la puerta a más amenazas y a la criminalización, articulado por actores no Estatales. En este marco, el trabajo de los y las periodistas se ha visto en riesgo durante este período gubernamental.

A pesar de los compromisos adquiridos ante la comunidad internacional y la firma del Acuerdo Nacional para el Avance de la Seguridad y la Justicia, el gobierno de Álvaro Colom no institucionalizó los mecanismos estatales de protección a defensores y defensoras de derechos humanos. No se consensó, ni aprobó un Programa de Protección para Defensores de Derechos Humanos y Otras Víctimas Vulnerables. Tampoco se institucionalizó la Instancia de Análisis a Ataques a Defensores de Derechos Humanos, la cual dejará de funcionar el 9 de enero de este año, ya que el acuerdo gubernativo sobre la materia, está en espera de opinión en la Secretaría General.

Por su parte, el Ministerio Público ha avanzado en el esclarecimiento de algunos casos de delitos cometidos en contra de defensores y defensoras de derechos humanos; siendo los más emblemáticos los de Cotzal (2009), Lisandro Guarcax (2010) y Emilia Quan (2010). Sin embargo, la mayor parte de casos se mantienen aún en impunidad, siendo los más descuidados aquellos de sindicalistas y periodistas. Un avance importante es la firma de un convenio de cooperación firmado entre el Ministerio Público, el Ministerio de Gobernación y la COPREDEH para apoyar a la coordinación en materia de persecución penal y protección a defensores y defensoras de derechos humanos. Esperamos que el nuevo gobierno, de el seguimiento oportuno y que esto permita seguir avanzando en esta materia mientras el mismo formula una política sobre la temática.

Resaltamos que durante este último año la CICIG avanzó en la investigación y persecución penal de estructuras que agreden defensores y defensoras de derechos humanos; tal es el caso del asesinato del defensor Víctor Gálvez (2009). Asimismo, reconocemos las investigaciones que realiza en conjunto con el Ministerio Público en varios casos en donde funcionan cuerpos ilegales y aparatos clandestinos de seguridad.

Caso contrario, es el de la Procuraduría de Derechos Humanos de Guatemala –PDH-, la cual durante los últimos años ha venido en deterioro de sus funciones y credibilidad. El vacío dejado por la Procuraduría, genera una situación de vulnerabilidad muy grave para defensores y defensoras de derechos humanos actuando en lo local y para la población en general.

Agradecemos a la comunidad internacional, la cual representa un rol importante en la protección a defensores y defensoras de derechos humanos, no sólo a través de la actividad de la Oficina de la Alta Comisionada de Derechos Humanos de las Naciones Unidas, sino también a través de la actuación de Embajadas, la Comisión Interamericana de Derechos Humanos y el sistema de las Naciones Unidas.

Al iniciarse el año 2012 y la gestión de un nuevo gobierno:

Llamamos a los defensores y defensoras de derechos humanos a mantenerse alertas y a continuar la denuncia sobre sus agresiones al sistema nacional e internacional.

Exhortamos a la comunidad internacional a mantener la vigilancia en torno a las agresiones en contra de defensores y defensoras de derechos humanos y a repudiar las acciones de difamación desarrolladas desde el Estado o consentidas por actores no estatales.

Exigimos al nuevo gobierno el cumplimiento de los compromisos adquiridos en el Acuerdo Global sobre Derechos Humanos, el Acuerdo Nacional para el Avance de la Seguridad y la Justicia y la Declaración Internacional sobre el Derecho y Deber de las Personas, Grupos e Instituciones a Promover y Defender los Derechos Humanos y Libertades Universalmente reconocidas.

2011: The Most Violent Year for Human Rights Defenders

2011: The Most ViolentYear for Human Rights Defenders

The Human Rights DefendersProtection Unit – Guatemala (Unidad de Protección a Defensoras y Defensores de Derechos Humanos – Guatemala; UDEFEGUA) reportsthat, according to our records, 2011 was the most violent year so far forhuman rights defenders. We counted a total of 402 violations of the right to defend human rights. Theaggressions were committed against 94 female human rights defenders,representing 23% of the cases; 293 male defenders, corresponding to73% of the cases, and 4% were committed against institutions. Incomparison with 2010, we see a rise of 33% in the number of casesregistered.

During the government ofÁlvaro Colom UDEFEGUA documented 1,224 acts of aggression, in comparison to 618 during the government of Oscar Berger and 338during the government of Alfonso Portillo. The gravity of thesituation for human rights defenders is directly related to the lackof attention to land conflicts and the repressive policies againstcommunities that object to the use of their resources withoutprevious consultation. The poor management of social conflictivitycaused the government of Colom to use States of Exception [similar to Martial Law] as amechanism of social control, aggravating the situation for humanrights defenders in the region.

During 2011, thegovernment of Álvaro Colom once again used the practice ofdefamation against human rights defenders and with this opened thedoor to more threats and criminalization committed by non-Stateactors. In this regard, the work of journalists has been put at riskduring this government.

Despite their commitmentsbefore the international community and the signing of the NationalAccord for the Advancement of Security and Justice, the government ofÁlvaro Colom has not institutionalized state mechanisms for theprotection of human rights defenders. They did not come to aconsensus, nor did they approve the Program for the Protection ofHuman Rights Defenders and Other Vulnerable Victims. Neither didthey institutionalize the Unit for Analysis of Attacks against HumanRights Defenders, which ceased to function on January 9^ththis year, given that thegovernmental agreement is awaiting the opinion of the president'soffice.

On the other hand, theDistrict Attorney has advanced in some cases regarding crimescommitted against human rights defenders; the most emblematic beingthe cases of Cotzal (2009), Lisandro Guarcax (2010) and Emilia Quan(2010). However, the majority of cases remain in impunity, particularly cases involving journalists and unionists. One importantadvance is the signing of the Convention for Cooperation signedbetween the Public Prosecutor's Office, the Ministry of theInterior, and the Presidential Commission for Coordinating ExecutivePolicy in Human Rights (COPREDEH) to support the coordination ofpenal prosecution and protection for human rights defenders. We hopethat the new government will follow up on these changes and allow advances to continue as they formulate apolicy on these themes.

We recognize that duringthis last year the International Commission against Impunity inGuatemala (CICIG) advanced in the investigation and penalprosecution of structures that attack human rights defenders; such asin the case of the murder of human rights defender Víctor Gálvez(2009). As such, we note the investigations undertaken with the Public Prosecutor's Office in variouscases in which there are illegal bodies and clandestine securityapparatuses functioning.

A contrasting case is thatof the Human Rights Ombudsman (Procuraduría de Derechos Humanos,PDH) which, in recent years has deteriorated in its functionalityand credibility. The vacuum left by the PDH has generated a verygrave situation of vulnerability for human rights defenders acting atthe local level, and for the population in general.

We thank the internationalcommunity, which has assumed an important role in the protection ofhuman rights defenders, not only through the activities of the Officeof the United Nations High Commissioner for Human Rights, but alsothrough the actions of the Embassies, the Inter-American Commission onHuman Rights and the system of the United Nations.

As we enter 2012and the administration of a new government:

We call on human rightsdefenders to remain alert and to continue reporting aggressions in national and international systems.

We urge the internationalcommunity to remain vigilant of aggressions against human rightsdefenders and to condemn acts of defamation by the State or by non-state actors with the State's consent.

We demand that the newgovernment comply with the commitments of the Global Accord on HumanRights, the National Accord for the Advancement of Security andJustice, and the InternationalDeclaration on the Right and Responsibility of Individuals, Groupsand Institutions to Promote and Defend Universally Recognized Human Rights and Freedoms.

Take Action: Justice for Emilia Quan

Emilia - we still remember you. The search for justice continues.

On the 8th of December 2011, the first anniversary of the tragic death of Emilia Quan Staackmann takes place. Emilia was a Guatemalan woman, 33 years old, that always will be remembered as a sociologist committed to her work and as a lively, human and intelligent person.

Emilia Quan was a researcher for the organisation Centro de Estudios y Documentación de la Frontera Occidental de Guatemala (CEDFOG) in Huehuetenango, Guatemala. On the 7th of December, when Emilia was heading for a field mission, she was kidnapped. On the 8th of December 2010, Emilia was found dead in circumstances that have not yet been clarified.

In relation to the first anniversary we are realising this electronic campaign to collect signatures. The signatures will be submitted to the Office of the General Attorney in Guatemala , the authority responsible for carrying out rapid, thorough and efficient investigations, in order to identify, judge and sanction the persons responsible for the death of Emilia Quan.

El 8 de Diciembre de 2011 se cumple el primer aniversario de la trágica muerte de Emilia Quan Staackmann. Emilia era una mujer guatemalteca de 33 años de edad, que siempre será recordada como una socióloga comprometida con su trabajo, alegre, humana e inteligente.

Emilia fue secuestrada en Huehuetenango el 7 de diciembre de 2010 mientras realizaba un viaje de campo relacionado con su trabajo en el Centro de Estudios y Documentación de la Frontera Occidental de Guatemala (CEDFOG), y encontrada muerta el día 8 de diciembre, en circunstancias que aún no han sido esclarecidas.

A propósito del primer aniversario de este hecho, estamos realizando esta campaña electrónica para recoger firmas, que serán entregadas al Ministerio Público en Guatemala, la autoridad responsable de llevar acabo investigaciones prontas, exhaustivas y eficaces, para que se identifique, juzgue y sancione a los responsables de la muerte de Emilia Quan.

The Association for Justice and Reconciliation (AJR) and the Center for Human Rights Legal Action (CALDH) have released a 30 minute documentary, "Our Voice, Our Memory: The genocide in Guatemala". The documentary, available in full online, uses survivor and expert testimony to explain the concept of genocide, demonstrating how the atrocities committed by the Guatemalan military against indigenous Maya communities satisfy the requirements of the international legal definition of genocide. English subtitles for the documentary are not currently available, please watch NISGUA's blog for updates.

La Asociación para la Justicia y Reconciliación (AJR) y el Centro para Acción Legal en Derechos Humanos (CALDH) han estrenado un documental de 30 minutos en duración, titulado "Nuestra Voz, Nuestra Memora: El genocidio en Guatemala." El documental, disponible en su totalidad por internet, emplea el testimonio de sobrevivientes y expertos para explicar el concepto del genocidio, demostrando que las atrocidades cometidos por el Ejército de Guatemala en contra de las comundiades indígenas Mayas llenan los requisitos de la definición legal internacional del genocidio.

The documentary was premiered in Guatemala City on November 9th to a packed audience including AJR members and other representatives of national and international civil society. Copies of the documentary will be freely distributed by CALDH as a means of raising public awareness and support for the national genocide trials, which are set to begin early next year.

Se estrenó el documental el 9 de noviembre en la Ciudad de Guatemala con una sala llena de miembros de la AJR y otros representantes de la sociedad civil nacional e internacional. Copias del documental serán distribuidos por CALDH como una forma de concientizar al público y levantar el apoyo para los juicios en el caso por genocidio, la apertura de los cuales se espera para el año próximo.

Military high command and former president arrested for Guatemalan genocide: Trials expected to open in 2012

Ten years have passed since genocide survivors filed cases against General Efraín Ríos Montt and members of his military high command. As a result of this investigation, in 2011, three former military officials—including a former president—have been arrested, andanother has been declared fugitive from justice.

On October 12, 2011, arrest warrants were issued for retired General and former de facto President Óscar Humberto Mejía Víctores, former intelligence chief General José Mauricio Rodríguez Sánchez, and former chief of operations General Luís Enrique Mendoza García. Rodríguez Sánchez was arrested and Mejía Víctores turned himself on October 24. Mendóza García, a graduate of the U.S.-run counterinsurgency training academy known as the School of the Americas, remains a fugitive.

Earlier this year, on June 17, 2011, retired General Héctor Mario López Fuentes was arrested, he has since been formally indicted for the charges of genocide, crimes against humanity and forced disappearance committed against the Maya Ixil people in the department of El Quiché. López Fuentes acted as Army Chief of Staff under the de facto government of Efraín Ríos Montt from 1982-1983.

Lawyers for López Fuentes and Mejía Víctores have argued that their clients are unfit to stand trial due to poor health. Both are detained in the Military Hospital in Guatemala City, and the legal processes against them remain open. Trials against the three arrested officials are expected to open in early 2012.

This marks the first genocide case in the Americas to be tried in a national court and the highest-ranking military officials to be charged for human rights violations in Guatemala. The Association for Justice and Reconciliation (AJR) and the Center for Human Rights Legal Action (CALDH), alongside the Attorney General’s office are the primary plaintiffs in the case.

Guatemala's President-elect and former General Otto Pérez Molina has publicly denied that the Guatemalan Army committed genocide, though he has stated that he will not interfere with cases in the justice system. Otto Pérez served as a commanding officer in the Quiché departmentduring the Ríos Montt regime.

Julia Cortez, legal representative of the AJR, reflected on the advance of the cases, “I am thinking about all of the people who have given their testimony, who spoke out and did not hide their truth. We will continue fighting against the genocide committed against the indigenous Maya people. We want justice.”

NISGUA has provided international human rights accompaniment to the AJR and CALDH since 2000. Through the Guatemalan Accompaniment Project, volunteers are trained as human rights observers, living and traveling alongside participants in the genocide cases as a form of non-violent protection and support.

Former General Wins Presidential Election in Guatemala

On November 6, Guatemala's presidential elections ended in a close victory for retired General Otto Pérez Molina. Pérez Molina's Patriot Party has promised an iron fist approach to security in the face of rising crime and international drug trafficking. Carrying a majority in urban and Eastern departments, Pérez Molina won 54% of the vote. With a populist discourse merging social promises with extremist stances on security and taxation, his opponent Manuel Baldizón of the LIDER party won a slight majority in the western highlands, the south coast, and his native department of Petén.

The Patriot Party administration would be the first since the 1986 transition from dictatorship to civilian government to be headed by a former military officer. In the mid 1980s Pérez Molina served as a commanding officer in the hard-hit Ixil region of the Quiché department, carrying out the Guatemalan military's brutal counterinsurgency campaign. As director of military intelligence during the 1990s, he is implicated in torture and disappearances, including the case of Efraín Bámaca. Pérez Molina has denied allegations of participation in human rights abuses and paints himself as a reformist within the military, highlighting his role in negotiating the 1996 Peace Accords. Pérez Molina's military career has raised strong concerns amongst civil society and human rights organizations. His administration will have the power to support or to block ongoing reforms of the justice system, the state's collaboration with the U.N. International Commission Against Impunity in Guatemala (CICIG), and the precedent-setting human rights cases that have advanced under the leadership of Attorney General Claudia Paz y Paz. Pérez Molina has publicly stated that he does not believe the Guatemalan military is responsible for genocide.

Among Pérez Molina's first acts as President-elect was to announce nominations for several key government ministries. Mauricio López Bonilla, a former military intelligence officer and Patriot Party campaign manager, will head the Interior Ministry, charged with implementing security policy, police reform, and counter-narcotics efforts. Alejandro Sinibaldi, failed Patriot Party candidate for mayor of Guatemala City, will serve as Minister of Transportation, Infrastructure and Housing, a strategic post in charge of lucrative state contracts. Francisco Arredondo was named for head of the Ministry of Health, which has been at the center of a bitter struggle between the Guatemalan Congress and health workers' unions over insufficient budgets and deteriorating conditions in the public health system.

Despite having the largest block in Congress, Pérez Molina's administration will not enjoy enough of a majority to pass legislation without seeking alliances with other parties. His administration faces a budget crisis precipitated by his party's refusal to approve international loans destined for health, education, and the justice system, as well as climate change mitigation, and initiatives against tax evasion. In addition to his promises to improve security, Pérez Molina has expressed his support for international investment in the mining and energy sectors, which may bring his government into conflict with communities which have organized to defend indigenous territory, natural resources, and self-determination. He has also committed his government to continue popular social programs which offer basic material support to impoverished families.

Pérez Molina's security proposals include the establishment of inter-agency task forces which will increase collaboration between police forces and the military. According to the Wall Street Journal, Pérez Molina "would welcome U.S. troops to battle drug gangs" in Guatemala. Ironically, human rights and security analysts have linked Pérez Molina and the Patriot Party to criminal organizations and military mafias. Meanwhile, the long-term involvement of members of the Guatemalan military in organized crime raises serious doubts about the institution's role in counter-narcotics and anti-crime operations.

As powerful local movements for justice and indigenous rights continue to grow, the attention and accompaniment of the international community will be crucial during the coming four years.

UNA AMENAZA GRAVÍSIMA SOBRE LA SALUD DE LAS COMUNIDADES SITUADAS EN LA PARTE BAJA

Desde el comienzo de las operaciones mineras, en San Miguel Ixtahuacán, San Marcos, Guatemala, en 1996 cuando esta entró en el territorio del pueblo Mam de San Miguel Ixtahuacán San Marcos, ha sido una empresa manipuladora porque los primeros que llegaron siempre negaron decir la verdad, nunca aclararon que iban a extraer oro plata en el territorio de San Miguel.

En 1998 cuando empezaron a comprar las tierras lo hicieron bajo amenaza, violando un derecho que tenemos los pueblos y ha sido ratificado por el estado de Guatemala, lo es el convenio 169 del Organización Internacional del trabajo de las naciones unidas, declaración universal de los derechos de los pueblos indígenas de las naciones unidas entre otros tratados internacionales y esto bajo la protección y manipulación del sistema operativo del derecho vigente en Guatemala. Violando este derecho del libre consentimiento previo en informado vigente en Guatemala, respeto a su territorio y la autodeterminación de los pueblos.

Esta violación del derecho del pueblo Mam continúan aun hoy, sin ser reconocida ni respetada por el estado de Guatemala y la mina marlín a pesar las demandas presentadas ante la Comisión Interamericana de Derecho Humanos de la Organización de los estados Americanos y del otorgamiento de las medidas cautelares por este alto organismo internacional en materia de los derechos humanos.

El día 2 de noviembre, varios vecinos y defensores de derechos humanos de las comunidades alrededor de la mina Marlin, han manifestado su preocupación y pena que se encuentran abajo del dique de cola (depósito de agua construido artificialmente donde se deposita el agua servida y mesclada con químicos altamente contaminantes) Este depósito de cola inicialmente no tiene ningún soporte de fondo, el agua se deposita sobre la tierra esto a su vez se ha filtrado en la tierra y el lago o deposito de cola está bajando enormemente el volumen, aproximadamente 2 metros de altura o de su capacidad, este desaparecimiento le preocupa a muchas familias alrededor de la empresa minera y las comunidades que viven abajo de la industria minera, ya que no saben a donde pudo salir esta cantidad de agua residual. Aproximadamente ha disminuido 2 metros., que han visto en los últimos 3 días y según testimonios de los trabajadores de la mina Marlin expresadas ante los vecinos, esto se visualiza que aproximadamente ha disminuido 2 metros. En la mayoría de fotos se observa un área tapado con Nylon plástico color negro, ignoramos para que lo han hecho ya que antes este no existía. Además todo lo que ha sucedido alrededor de la mina el pueblo lo desconoce, las autoridades guatemaltecas no han sido transparentes con sus acciones, el cual es otra forma de violar nuestros derechos como pueblo Mam de San Miguel Ixtahuacán.

Las causales de que esto ocurran no se sabe a ciencia cierta, lo que sí es cierto es que el agua o deposito de colas está disminuyendo en gran manera y eso es una preocupación a muchas familias que viven alrededor del gran rio Cuilco, puesto que muchos de estas familias son productoras de tomate, cebolla entro otros productos de consumo para los mercados locales en las comunidades de San Marcos, Huehuetenango y Chiapas México, y el paso del rio Cuilco en Guatemala se desemboca al rio Grijalva en México y luego al mar pacifico lo que significa una gran amenaza para muchos pueblos y comunidades.

Ante este hecho solicitamos:

Al Ministerio del Medio Ambiente y recursos Naturales la pronta intervención . Para que verifique este hecho con la participación de las comunidades en defensa de su territorio.

Al ministerio de Energía y minas pedimos que tome medidas para que el agua no perjudique a las comunidades que se encuentran amenazadas e indicadas en este documento

A la Comisionada Presidencial de Derechos Humanos solicitamos su pronta intervención y verificación personalmente.

Al señor procurador De Derechos Humanos de Guatemala exigimos su intervención de forma inmediata en forma personal para la verificación de esta amenaza para la vida de las familias.

TWO MEMBERS OF MILITARY ACCUSED OF GENOCIDE

FUGITIVES FROM JUSTICE

On October 12, First Tribunal Judge Carol Patricia Flores gave the arrest orders for three members of the military responsible for the genocide in Guatemala. One was captured, while the other two – Generals Oscar Humberto Mejía Víctores and Luis Enrique Mendoza Garcia - now find themselves fugitives from the law.

The members of the military with arrest warrants formed part of the Department of Defence in the de facto government of General Efraín Ríos Montt and actively participated in the intellectual planning of the genocide against the Maya Ixil people through Plan Victoria 82. Their roles were fundamental in the commission of crimes against humanity and genocide during this time.

General Luis Enrique Mendoza Garcia was Director of Operations (G3) in the Army General Staff between April 1982 and August 1983; this position involved the elaboration of orders to mount and execute the entire operation of Plan Victoria 82, with knowledge of each of the steps the troops undertook in real time.

General Oscar Humberto Mejía Víctores was Vice Minister of Defence, in charge of the office of the Ministry of National Defence and formed part of the military high command; his functions included supervising and coordinating military actions planned in Victoria 82 and other plans, which gave him the capacity to know what happened in the interior of the country in real time.

We express our concern that two members of the military have run from the law; we demand that the relevant authorities pursue these two fugitives; we hope that there are no officials that could be implicated in the flight of these members of the military. It is important to note that General Mejía Víctores has an international arrest warrant, and as a result, cannot leave the country. If the general public has information on the whereabouts of these members of the military, we call on you to report to the Public Ministry or the National Civil Police.

We consider that the arrest warrants represent an important step; however, it is essential that this process continues to bring to justice those responsible for serious crimes that attack the dignity of all humanity. We will continue with the struggle for justice, resisting impunity and the threat of another genocide.

PRÓFUGOS DE LA JUSTICIA

DOS MILITARES ACUSADOS DE GENOCIDIO

El 12 de octubre, la Jueza Carol Patricia Flores del Juzgado Primero de Primera Instancia Penal, Narcoactividad y Delitos contra el Ambiente de Mayor Riesgo, giró las órdenes de captura contra tres militares responsables del genocidio en Guatemala, dando como resultado la captura de uno de los tres y encontrándose prófugos de la justicia los generales Oscar Humberto Mejía Víctores y Luis Enrique Mendoza García.

Los militares con órdenes de captura integraron el Estado Mayor de la Defensa del gobierno de facto del general Efraín Ríos Montt y participaron activamente en la planificación intelectual del genocidio contra el pueblo maya Ixil a través del Plan Victoria 82. Sus funciones fueron fundamentales para la comisión de los delitos de lesa humanidad y genocidio en dicha época.

El general de división Luis Enrique Mendoza García fungió como Director de la Sección de Operaciones (G3) del Estado Mayor General del Ejército entre abril del 82 y agosto del 83; dicho cargo implicó la elaboración de las órdenes para la ejecución y montar todo lo operativo para la ejecución del Plan Victoria 82, teniendo conocimiento de cada uno de los pasos que realizaban las tropas en tiempo real.

El general Oscar Humberto Mejía Víctores fungió como Vice Ministro de la Defensa encargado del despacho y Ministro de la Defensa Nacional e integró el Alto Mando Militar; su funciones consistieron en supervisar y coordinar las acciones militares planificadas en el Victoria 82 y otros planes, lo que le daba la facultad de conocer lo que pasaba en el interior en tiempo real.

Manifestamos nuestra preocupación ante el hecho de que dos militares se hayan dado a la fuga; exigimos a las autoridades correspondientes la persecución de estos prófugos; esperamos que no hayan funcionarios que pudieran tener alguna responsabilidad en la fuga de estos militares. Es importante destacar que el general Mejía Víctores tiene orden de captura internacional, por lo que no puede salir del país. Exhortamos a la población en general que tenga información sobre el paradero de estos militares a que reporte al Ministerio Público o la Policía Nacional Civil.

Consideramos que las órdenes de captura representan un paso importante, sin embargo, es indispensable que se cumplan las mismas para llevar ante la justicia a los responsables de un delito grave que lastima la dignidad de la humanidad entera. Continuaremos con la lucha por la justicia, seguiremos resistiendo ante la impunidad y la amenaza de otro genocidio.

LA JUSTICIA CAMINA,

LA IMPUNIDAD LE PONE OBSTÁCULOS

Después de 29 años de impunidad en los delitos de lesa humanidad y genocidio cometidos durante el conflicto armado interno en contra del pueblo maya, el jueves 13, la Jueza Carol Patricia Flores deja ligado a proceso a uno de los autores intelectuales del genocidio, el general José Mauricio Rodríguez Sánchez quien fungió como Director de la Sección de Inteligencia (G2) del Estado Mayor General del Ejército, de abril del 82 a abril del 83, en el gobierno de Efraín Ríos Montt.

En el año 2001, las víctimas sobrevivientes del genocidio interpusieron una querella contra el alto mando militar de 1982-1983 integrado por el Jefe de Estado, Efraín Ríos Montt, el Ministro de la Defensa General, Oscar Humberto Mejía Víctores y el General Héctor Mario López Fuentes. Después de casi diez años, el Ministerio Público ha culminado con la investigación de dicho caso y solicita la orden de captura de uno de los implicados, dándose exitosamente y quedando éste ligado a un proceso judicial.

Manifestamos nuestra complacencia por este hecho que demuestra que en Guatemala se están iniciando a crear condiciones para juzgar graves violaciones a los derechos humanos cometidas durante el conflicto armado. Esperamos que el resto del proceso continúe con actuaciones como estas que fortalecen el estado de derecho en nuestro país.

La justicia camina, pero la impunidad le pone obstáculos. Nuevamente, el general López Fuentes, evadió la justicia en un acto repudiable. Hoy se realzaría la diligencia para que Jueza determinara la apertura a juicio oral y público, en el Hospital Militar, sin embargo, el general genocida se encontraba en estado de inconciencia, sin poderse establecer si era a causa de su estado médico o producto por haber sido sedado a propósito, motivo por el cual no se pudo realizar la audiencia.

Mientras la Jueza y las partes procesales del caso estaban en la habitación de López Fuentes, en la entrada principal del Hospital Militar, familiares de víctimas, sobrevivientes y activistas realizaron una alfombra floral con la palabra JUSTICIA. En silencio y agarrados de las manos se esperó el resultado de la audiencia mientras militares intimidaban tomando fotografías a los presentes y exigiendo que no se hiciera dicha alfombra.

A pesar de no haberse podido realizar la audiencia, no cesaremos en exigir justicia y perseguir penalmente a uno de los mayores responsables intelectuales del genocidio. Este obstáculo más no será el motivo para detenernos. Continuaremos diciendo la verdad, recuperando nuestra memoria y caminando hacia la justicia.

After 29 years of impunity for crimes against humanity and genocide committed during the internal armed conflict against the Maya People, on Thursday October 13 Judge Carol Patricia Flores indicted one of the intellectual authors of the genocide - José Mauricio Rodríguez Sánchez - who was the Director of Intelligence (G2) for the military high command from April 1982 to April 1983 in the government of Efraín Ríos Montt.

In 2001, survivors of the genocide launched a case against the 1982-1983 military high command made up of Head of State Efraín Ríos Montt, Minister of Defence General Oscar Humberto Mejía Víctores and General Hector Mario Lopez Fuentes.

After almost 10 years, the Public Prosecutor has culminated with the investigation of the case and solicited an arrest warrant for one of the implicated and has begun a judicial procedure.

We express our satisfaction with this arrest, which shows that Guatemala is beginning to create conditions to try serious violations of human rights committed during the armed conflict. We express our hope that the rest of the process will continue with events like this that strengthen the rule of law in our country.

Justice progresses, but impunity presents obstacles. Again, General Lopez Fuentes evaded justice. In the Military Hospital today, the judge was to determine whether the public oral debate could open; nevertheless, the genocidal general was found in a state of unconsciousness. It was unclear whether or not it was due to his medical condition or from having been excessively sedated, and as a result, the hearing could not be conducted.

While the judge and the litigants in the case were in the room of Lopez Fuentes, relatives of victims, survivors and activists made a floral carpet with the word "JUSTICE" in front of the main entrance to the hospital. In silence and holding hands awaiting the outcome of the hearing, members of the military attempted to intimidate those present by taking photos and requesting they not make the carpet.

Despite not having been able to conduct the hearing, we will not cease to demand justice and the prosecution of one of the most responsible intellectual authors of the genocide. This obstacle will not be the reason to stop. We will continue telling the truth, recuperating our historic memory and walking towards justice.

New genocide charges brought against military high command

José Mauricio Rodríguez Sánchez, former Director of Military Intelligence under the de facto government of Efraín Rios Montt, has become the second person to be formally charged with genocide after he was arrested on October 12, 2011.

Rodríguez Sánchez is accused as an intellectual author of military counter-insurgency campaigns between 1982 and 1983, detailed in the military documents Plan Victoria 82, Plan Sofia and Plan Firmeza 83, that resulted in genocide against the Maya Ixil people.

In his role as director of the G-2, he served directly under Army Chief of Staff Hector Mario López Fuentes and Minister of Defense Oscar Humberto Mejía Víctores - the second and third in command under Rios Montt. On June 20^th, 2011 López Fuentes became the first person in Guatemala to be formally indicted on charges of genocide against rural and indigenous populations during the internal armed conflict. State officials also issued an arrest warrant for Mejía Víctores yesterday, but he is now considered a fugitive from the law after evading arrest. Authorities are also searching for former military intelligence official Luís Enrique Mendoza García, wanted on similiar charges.

Formal charges against Rodríguez Sánchez were presented on October 13^th when the Public Prosecutor accused him of committing genocide and crimes against humanity in at least 71 different incidents. He is accused of having orchestrated the violent death of at least 317 people, the cruel and inhumane treatment of the Ixil people, the use of torture, sexual violence, psychological operations and the destruction of sacred spaces. Amongst the charges, he is also being accused of forcibly displacing more than 29,000 people from 54 communities between 1982 and 1983, and systematically burning and destroying homes.

The arrests in the genocide case are the result of over a decade of work by CALDH (Center for Legal Action in Human Rights) and the AJR (Association for Justice and Reconciliation) to bring to justice the intellectual authors of crimes committed during the armed conflict. The sudden movement in this case and other high-profile cases can in part be attributed to the appointment of Claudia Paz y Paz as Attorney General in 2010.

Hearing suspended pending verification of health of Héctor Mario López Fuentes

First suspended on September 21 and reprogrammed for October 3, the hearing for the intermediate phase of the case against retired general Héctor Mario López Fuentes, accused of intellectual authorship of a genocide against the Maya Ixil People, as well as crimes against humanity and forced disappearance, was suspended once more pending the verification of the health of the defendant.

A brief article published in the Prensa Libre on September 30 indicated that the accused would be absent during the audience as the National Institute of Forensic Science of Guatemala (INACIF) had informed the court responsible for hearing high-risk cases that the former head of the Army Chief of Staff was in delicate health. When asked at the beginning of the hearing on October 3 whether he was authorized to represent his client in his absence, the legal defense of López Fuentes replied that the accused was not in sufficiently good health physically or mentally to be capable of delegating his lawyer the responsibility of representing him before the court. The prosecution proposed the judge personally verify the health of the accused, as she is authorized to do by law. The judge acceded and, having programmed a visit to López Fuentes where he remains in the Military Hospital, suspended the hearing.

Suspendida por primera vez el 21 de septiembre y reprogramada para el 3 de octubre, la audiencia para la fase intermediaria del caso que se lleva contra el general retirado Héctor Mario López Fuentes, a quién se le imputa la autoría material en un genocidio cometido contra el pueblo maya ixil, así como crímenes de lesa humanidad y desaparición forzada, volvió a aplazarse pendiente la verificación del estado de salud del acusado.

En una nota salida el 30 de septiembre en la Prensa Libre, se informó que el acusado estaría ausente durante la audiencia, puesto que el Instituto Nacional de Ciencias Forenses de Guatemala -INACIF- había informado al Juzgado Primero de Alto Riesgo que el ex-titular del Estado Mayor del Ejército se encontraba enfermo. Iniciada la audiencia el 3 de octubre, se le preguntó al abogado defensor de López Fuentes si se encontraba facultado para representar a su cliente en su ausencia, a lo cual respondió que López Fuentes no se encontraba en condición física y mental para delegarle a su abogado la responsabilidad de representarlo al tribunal. El Ministerio Público pidió que la jueza se movilizara para verificar personalmente el estado de salud del ex-militar, potestad que le faculta la ley. Accedió y, habiendo programado visitar el 4 de octubre al acusado donde reposa en el Hospital Militar, dio por suspendida la audiencia.

Pedro Pimentel Rios To Be Tried for Murder and Crimes Against Humanity

Guatemala – First Tribunal Judge Carol Patricia Flores found Guatemalan ex-military Pedro Pimentel Rios' defense to be without merit yesterday, ruling that the accused can be tried for mass murder and crimes against humanity in the case of Las Dos Erres.

Pimentel Rios' lawyer argued that nowhere in the formal accusation does it include the names of specific people his client allegedly killed, nor is there ballistic evidence to directly incriminate him.

Instead, Pimentel Rios is accused alongside 16 others of having participated in an elite squadron of Guatemalan kaibiles who executed a massacre of more than 200 unarmed civilians in the community of Las Dos Erres on December 7th, 1982.

In August of this year, three implicated ex-kaibiles and one ex-military commissioner were condemned to more than 6000 years in prison for the murder of 201 people and for crimes against humanity for their participation in this massacre.

Briefly citing eye-witness and expert testimonies given during that historic trial, Flores ruled that there was sufficient probability that Pimentel Rios was directly involved in the massacre to warrant going to trial for murder.

Guatemala - Ayer, Jueza Carol Patricia Flores del Tribunal de Primera Instancia de Sentencia Penal de Narcoactividad y Delitos contra el Ambiente declaró sin lugar los argumentos de la defensa del ex-militar Pedro Pimentel Ríos, declarando que el acusado pueda ser juzgado por el crimen de asesinato y delitos en contra de deberes de la humanidad en el caso de la masacre de las Dos Erres.

El abogado de Pimentel Rios sustuvó que en ningún lugar de la acusación formal existían nombres específicos de las personas supuestamente matados por su cliente, ni evidencia balística para incriminarlo.

Junto con otros 16 hombres, Pimentel Ríos es acusado de haber participado en un escuadrón elite de kaibiles quienes masacraron más de 200 civiles en la comunidad de las Dos Erres, departamento de Petén, el 7 de diciembre de 1982.

En agosto del 2011, tres ex-kaibiles y un teniente fueron condenados a más de 6000 años por el asesinato de 201 personas y por delitos en contra de deberes de humanidad por su participación en este massacre.

Refiriéndose a los testimonios oculares y los peritajes presentados en aquel juicio histórico, Jueza Carol Patricia Flores declaró que hay suficiente probabilidad que Pimentel Ríos fue directamente involucrado en la masacre para justificar que sea juzgado por asesinato y delitos en contra de deberes de humanidad.

Se celebra festival muralistico en Archivo Histórico de la Policía Nacional

El 24 de septiembre se celebró en el Archivo Histórico de la Policía Nacional -AHPN- el segundo de una serie de festivales muralísticos realizándose a lo largo del 2011, contando con la participación de diversos colectivos de artistas incluyendo Pie de Lana, el Colectivo del Clavel Rojo, Fe y Esperanza, así como trabajadores y familiares de trabajadores del Archivo. La riqueza documental que hoy custodia el equipo de la AHPN concerniente al actuar de uno de los cuerpos más represivos operantes durante la guerra civil de Guatmala salió a la luz en julio del 2005, cuando el estallido de un artefacto explosivo en una instalación militar en las afueras de la capital llevó a un equipo de defensores de derechos humanos a realizar una investigación en otras instalaciones pertenecientes a la seguridad pública, con el fin de averiguar si existían riesgos similares. Ingresados en un edificio de un complejo de la Policía Nacional Civil, en la Zona 6 de la Ciudad de Guatemala, dieron con millones de documentes referentes al quehacer interno de la antigua Policía Nacional, cuerpo disuelto con la firma de los acuerdos de paz, al final de la guerra civil de Guatemala. Desde el 2006, en un esfuerzo apoyado por los gobiernos de distintos países europeos, trabaja incansablemente un equipo de personas entregadas a la preservación y puesta a servicio de la sociedad guatemalteca de la información hallada. En una conferencia de prensa, el Coordinador Nacional del AHPN, Gustavo Meoño, dio a conocer de los avances habidos a lo largo de seis años de trabajo archivístico realizado por el equipo de 150 personas que laboran en el Archivo, tanto preservando, digitalizando y sistematizando la documentación que contiene como respondiendo a solicitudes de acceso a la misma. Manifestó que el AHPN alberga ocho kilómetros lineales de documentos comprendidos por unos 80 millones de folios, que abarcan desde el año 1881 hasta el 1997, año de la disolución de la antigua Policía Nacional. De los 80 millones de documentos, explicó Meaño que 20 millones han sido procesados, 13 millones de ellos habiendo pasado ya a la digitalización, etapa definitiva del proceso archivístico.

Hablando del rango de documentos en el cual el equipo del AHPN ha puesto su enfoque, refirió que ". . . fue necesario adoptar el criterio de prioridad que se deriva de las conclusiones tanto del informe del REMHI, que encabezó Monseñor Gerardi, como del Informe de la Comisión para el Esclarecimiento Histórico, que establecen que ese período de 11 años de 1975 a 1985 fueron los años más terribles del terrorismo del estado, del genocidio, de la represión, de las violaciones a los derechos humanos que se cometieron en Guatemala". Por esta razón, todos los documentos digitalizados hasta la fecha corresponden al período referido.

Precisó Meoño que tanto los 20 millones de documentos intervenidos como los 13 millones digitalizados hasta la fecha corresponden al período 1975-1985, época durante la cual, de acuerdo a los informes de la Recuperación de la Memoria Histórica -REMHI- y la Comisión de Esclarecimiento Histórico -CEH-, fueron cometidos la mayoría de los abusos contra los derechos humanos perpetrados a lo largo del conflicto armado interno de Guatemala. Lo más fundamental de la digitalización los 13 millones de documentos referidos, afirmó, es que con ello todos los mismos han sido puestos a la disposición del público. Asimismo, informó que hasta el 15 de septiembre, 2011, la Unidad de Acceso a la Información del Archivo ha respondido 5,801 requerimientos de información, entregando un total de 82,705 documentos integrados por 281,421 páginas de información. "Es sin duda la unidad de acceso a la información que mayor cantidad de solicitudes ha atendido, y que sobre todo mayor cantidad de información ha podido brindar", afirmó.

En referencia a las partes que requieren la información, observó Meoño que "Los usuarios de este archivo son, en primer lugar, familiares de víctimas de violaciones a los derechos humanos, víctimas sobrevivientes, que se acercan en búsqueda de información sobre sus seres queridos, sobre si mismos--muchísimos casos ligados a la desaparición forzada de las personas. Por esto constituye para nosotros una responsabilidad muy grande. Constituye también un estímulo permanente para hacer cada día un trabajo más eficiente, un trabajo más eficaz, pero sobre todo un trabajo más profesional".

Fruto de una colaboración con el Museo de la Palabra y la Imagen y el Centro Pastoral Monseñor Romero, ambos de El Salvador, así como grupos afines en Guatemala, en el AHPN se inauguró una exposición reuniendo fotos y afiches que conmemoran la vida y el martirio tanto de Monseñor Juan Gerardi, asesinado el 26 de abril, 1998, dos días después de presentar el informe ¡Guatemala Nunca Más!, así como de Monseñor Óscar Romero, asesinado por un escuadrón de la muerte en San Salvador el 24 de marzo, 1980. También se incluyó material conmemorando a los seis sacerdotes jesuitas, su ama de llaves y su hija asesinados el 16 de noviembre, 1989, a manos de las fuerzas armadas de El Salvador.

Indicó Meoño que el ente que mas requerimientos ha hecho es el Ministerio Público -MP-, y dio a conocer que a partir de mayo del año en curso está instalada y operante una unidad del MP que trabaja de forma permanente en el empeño del análisis archivístico en apoyo a distintos casos judiciales que se llevan por crímenes contra los derechos humanos cometidos durante el conflicto armado en Guatemala. Subrayó de manera especial que a lo largo de los seis años de operación del Archivo Histórico, se ha llegado a comprender la importancia fundamental que tiene no solamente el proveer acceso a la información que contiene, sino también aportar el análisis archivístico que corresponde. "La experiencia nos demostró que no basta con dar acceso a la información, no basta con brindar los documentos", refirió. "Porque la lógica de la investigación archivística es otra. Es diferente—incluso, tuvimos algunas experiencias donde los fiscales o los querellantes, los abogados no veían la importancia y la utilidad de los documentos. Y entonces tuvimos que dar un paso muy importante, también brindando el servicio del análisis archivístico. Entonces, hemos desarrollado un equipo para el análisis archivístico. Y eso llevó también a pasar a algo fundamental que es el peritaje archivístico, la pericia técnica necesaria en los procesos judiciales".

Como ejemplo de ello, Meoño destacó la importancia del análisis archivístico en el caso judicial que se lleva en busca de justicia por la desaparición forzada de Edgar Fernando García. En el caso referido, fue con la coincidencia entre dos documentos hallados en el Archivo Histórico que se logró establecer la autoría material de agentes policiacos en la desaparición de García, así como conocer la cadena de mando involucrada. En un primer documento, se ofició la condecoración de cuatro agentes del Cuarto Cuerpo de la Policía Nacional por la aprehensión de dos "terroristas" en un operativo ejectutado a las 11 AM del 18 de febrero de 1980 en las cercanías del Mercado El Guarda, de la ciudad capital. Dicho oficio no hizo referencia explícita a Fernando García. El segundo documento, sin embargo, un recurso de exhibición personal interpuesto por la madre y la esposa del desaparecido, Emilia García y Nineth Montenegro, respectivamente, exhibió una coincidencia exacta con el primero. En él, explicó Meoño, ". . . ellas denunciaban que Edgar Fernando García había sido capturado por elementos de la Policía Nacional el 18 de febrero a las 11 de la mañana a inmediaciones del mercado de El Guarda. Entonces, hasta parecía que [las autoridades policiacas] habían sacado la información—para proponer que los condecoraran— habían casi como copiado. Entonces, esos dos documentos, con el sello de recibido del Cuarto Cuerpo, resultaron fundamentales".

En la conferencia de prensa, Julio Solórzano Foppa, hijo de la poeta Alaída Foppa, detenida y desaparecida en diciembre de 1980, hizo referencia al significado de la estructura física en la cual se desarrollan las labores del equipo archivístico del AHPN, estructura la cual fue ocupada por la misma Policía Nacional durante los años más cruentos de la guerra. "[E]n este lugar donde estuvo alojado el Sexto Cuerpo de la Policía—aquí se cometieron torturas, desapariciones, violaciones de mujeres, con el objeto de obtener información, etcétera. Éste funcionó como un centro de represión", enfatizó.

Con una celebración ecuménica se rindió homenaje a los detenidos-desaparecidos que fueron a parar a La Isla, una cárcel clandestina operada por el Sexto Cuerpo de la ahora extinta Policía Nacional, que a principios de los años 80 tuvo sus instalaciones en el mismo edificio que alberga el AHPN. También se conmemoró a todos los 45,00 desaparecidos a lo largo de Guatemala durante toda la guerra civil.

Solórzano Foppa reflexionó sobre la inspiración que anima la labor del Archivo Histórico, declarando que "queremos saber qué sucedió, y queremos saberlo no nada más por relatos personales o por testimonios, sino por documentos. Que este conocimiento de la verdad—que es la manera como se construye la memoria—nos sirva para que el país pueda asimilar lo que sucedió, para que se empiece—como estaba planteado en las recomendaciones de la Comisión para el Esclarecimiento Histórico—que se empiece a educar a nuestros niños sin temor a decir: 'en este país sucedieron estas tragedias'. Nosotros tenemos que aprender a vivir con lo que ha sucedido en este país, entre otras cosas, para hacer justicia, pero también para que estos hechos no vuelvan a repetirse nunca jamás. Se tiene que entender que esto no debe de repetirse, pero también, en un proceso que nos ayude a entender que la violencia y la impunidad con la que vivimos hoy en Guatemala tienen también un origen en esa violencia y en esa impunidad de esos momentos."

Indicó Solórzano Foppa que los murales pintándose en las instalaciones del AHPN se inspiran en dos temas fundamentales: la memoria y la esperanza. "Vamos a contar qué pasó, o cómo vemos lo qué pasó, pero también vamos a contar qué país queremos: cómo concebimos un país sin violencia, un país en que no vuelvan a repetirse los acontecimientos que llevaron a esta terrible situación, en donde, según el REMHI y la Comisión de Esclarecimiento Histórico, hay un número terrible de 200,000 víctimas, de las cuales 45,000 desaparecidos".

Mural festival celebrated in Historical Archive of the National Police

On September 24, the Historical Archive of the National Police (AHPN) celebrated the second of a series of mural-painting festivals being carried out throughout 2011, with the participation of artists' groups including Pie de Lana, the Clavel Rojo Collective, and Fe y Esperanza, as well as employees and family members of employees of the Archive. The wealth of documentation managed today by the staff of the AHPN regarding the activities of one of the most repressive forces in operation during Guatemala's civil war came to light in July of 2005, when the detonation of an explosive device in a military building in the outskirts of the capital led a team of human rights workers to conduct an investigation of other structures belonging to the public security authorities, in order to detect similar risks. Having entered into a building located in a police complex in Zone 6 of Guatemala City, the team came across millions of documents referring to the internal functioning of the National Police, a force that was disbanded with the signing of peace accords at the end of Guatemala´s civil war. Since 2006, in an effort supported by the governments of a number of European nations, a team of dedicated individuals works tirelessly to preserve the documents and place them at the service of Guatemalan society. In a press conference, the National Coordinator of the AHPN, Gustavo Meoño, informed as to the advances made over six years of archival work carried out by the team of 150 people who work at the Archive, preserving, digitalizing and systematizing the documentation it contains, as well as attending to requests for access to that documentation. He explained that the AHPN houses what amounts to eight longitudinal kilometers of documents made up of 80 million files covering the period from 1881 to 1997, year in which the National Police was disbanded. Of the 80 million documents, Meaño explained that 20 million have been archived, of which 13 million have been digitalized, the culminating phase of the archival process.

For this reason, all of the documents digitalized to date correspond to this period.

Meoño clarified that both the 20 million documents archived and the 13 million digitalized to date correspond to the period 1975-1985, period in which, according to the reports of the Recuperation of the Historical Memory (REMHI) and the Historical Clarification Commission (CEH), the majority of human rights abuses committed during Guatemala's civil war took place. The most important aspect of the archiving and digitalization of the 13 million documents, he underlined, is that they are all now available to the public. He informed that up to September 15, the Department of Information Access of the Archive has attended to 5,801 requests for information, providing a total of 82,705 documents containing 281,421 pages of information. "It is without a doubt the Department of Information access that has attended to the greatest number of requests and which, above all, has been able to provide the greatest amount of information," he affirmed.

In reference to the parties that request the information, Meoño observed that "the users of this archive are, in the first place, family members of victims of human rights violations and victims who have survived such violations, who come in search of information about their loved ones and about themselves--many cases linked to the forced disappearance of individuals. For this reason we feel a great sense of responsibility. This sense also continually impels us to work more and more efficiently, more effectively, and above all, professionally."

The product of a collaboration between the Museum of the Image and the Word and the Monseñor Romero Pastoral Center, both in El Salvador, as well as Guatemalan partners, the AHPN inaugurated an exhibition bringing together photos and posters commemorating the life and martyrdom of Monseñor Juan Gerardi, assassinated on April 26, 1998, two days after presenting the ¡Guatemala Nunca Más! truth commission report, as well as Monseñor Óscar Romero, assassinated by a death squad in San Salvador on March 24, 1980. The exhibition also included material commemorating the six Jesuit priests, their housekeeper and her daughter, assassinated on November 16, 1989 by members of the Salvadoran armed forces.

Meoño indicated that the entity that has made the most requests for information is the Public Ministry (MP), and revealed that since May of this year a permanent unit of the MP is installed and operating in the Archive, working in archival analysis corresponding to legal cases dealing with human rights abuses committed during Guatemala's civil war. He emphasized the fundamental importance of not only providing access to the information but also contributing the analysis necessary to understand it. "Experience showed us that it is not enough to provide the documents," he explained. "Because the logic of archival investigation is different. It's different—we even had some experiences in which the investigators, the plaintiffs and the lawyers didn't see the importance or the utility of the documents. And so we had to take a very important step, providing the service of archival analysis as well. We now have developed a team dedicated to archival analysis. And this led to something fundamental which is archival expert testimony, the technical expertise necessary in judicial processes."

As an example, Meoño underlined the importance of archival analysis in the legal case underway in search for justice for the forced disappearance of Edgar Fernando García. In this case, it was the coincidence between two documents found in the Historical Archive that allowed authorities to establish the material authorship of police agents in the crime, as well as discovering the chain of command involved. The first document referred to the decoration of four agents belonging to the Fourth Body of the National Police for the apprehension of two "terrorists" in an operation carried out at 11 AM on February 18, 1980 near the El Guarda Market in Guatemala City. Said document did not make explicit reference to Fernando García. The second document, however, a writ of habeas corpus filed by the mother and the wife of the disappeared, Emilia García and Nineth Montenegro, respectively, exhibited an exact coincidence with the first. In the document, Meoño explained, ". . . the two women denounced that Edgar Fernando García had been captured by members of the National Police on February 18 at 11 in the morning just outside the El Guarda Market. Therefore, it even looked like [the police authorities] had taken the information—to propose the decoration—that they had copied it. In this way, these two documents, which carried the official seal of the Fourth Body, turned out to be fundamental."

During the press conference, Julio Solórzano Foppa, son of the poet Alaída Foppa, detained and disappeared in December of 1980, made reference to the significance of the physical structure in which the archival team of the AHPN carries out its work, a structure which was used by the National Police during the bloodiest years of the war. "In this place, which housed the Sixth Body of the Police—here torture was committed, disappearance, rape, with the object of obtaining information, etcetera. This was a center of repression," he emphasized.

An ecumenical celebration was carried out to honor the detained and disappeared held at La Isla, a clandestine prison operated by the Sixth Body of the National Police, which en the early 1980s occupied the same building that today houses the AHPN. The ceremony also honored the 45,00 disappeared throughout all of Guatemala during the 36-year civil war.

Foppa reflected on the inspiration that drives the work of the Historical Archive, declaring that ". . . we want to know what happened, and we want to know not just by personal stories or testimonies, but by documents. May this knowledge of the truth—which is the way memory is constructed—help this country to assimilate what happened, so that—as was put forth in the recommendations of the Historical Clarification Commission—we may begin to educate our children without fearing to say: 'In this country, these tragedies occurred.' We need to learn to live with what happened in this country, among other reasons, so that justice may be served, but also so that these crimes aren't committed ever again. It must be understood that this past must not be repeated, but this understanding must grow out of a process that helps us to understand that the violence and the impunity with which we live today in Guatemala also has an origin in the violence and impunity of those times."

Foppa indicated that the murals being painted in the AHPN are inspired in two fundamental themes: memory and hope. "We are going to tell what happened, or how we see what happened, but we are also going to tell what we want: how we conceive of a country without violence, a country in which the happenings that led to this horrible situation will not be repeated, a situation in which, according to the REMHI and the Historical Clarification Commission, there was a terrible number of 200,000 victims, 45,000 of them disappeared."

Por favor firme nuestra petición en línea y emprendan otras acciones en apoyo de la Asociación para la Justicia y Reconciliación (AJR) y el Centro para la Acción Legal en Derechos Humanos (CALDH), querellantes en el caso.

Miembros de la AJR viajaron de cinco regiones distintas de la provinica de Guatemala para estar presentes en la apertura del juicio. Esperando afuera de la sala del tribunal, se les informó que el juicio había sido suspendido por cuestiones de un fallo administrativo por el cual no se transfirió un expediente de la Cámara de Apelaciones a la jueza competente que conoce el caso.

En declaraciones a la prensa, tanto la representante de la AJR, Julia Cortéz, como el abogado de CALDH Francisco Soto mantuvieron que se trata de una estrategia por retrasar el proceso legal. Mientras la demora es decepcionante, miembros de la AJR expresaron que están más comprometidos que nunca en la causa.

La apertura del juicio fue reprogramado para el 3 de octubre.

López Fuentes fungió como Jefe del Estado Mayor bajo el gobierno de facto de Efraín Ríos Montt y es el oficial militar de mayor rango procesado por actos de genocidio cometidos a lo largo de la guerra civil de 36 años de Guatemala. Este es el primer caso por genocidio en ser procesado en una corte nacional en Latinoamérica.

The highly anticipated genocide trial for General López Fuentes, scheduled to open today, has been suspended.

Please sign our online petition and take other actions to support the Association for Justice and Reconciliation (AJR) and the Center for Human Rights Legal Action (CALDH), plaintiffs in the case.

Members of the AJR traveled from five different regions of rural Guatemala to be present for the opening of the case. Waiting outside the courtroom, they were informed the trial was suspended due to an administrative failure to transfer a file from the Appellate Court to the presiding judge.

In statements to the press, both AJR representative Julia Cortéz and CALDH lawyer Francisco Soto maintained this is a strategy to further delay the legal process. While the delay is disappointing, members of the AJR expressed they are more committed than ever to their cause.

A new trial date was set for October 3rd.

López Fuentes served as Army Chief of Staff under the de facto government of Efraín Ríos Montt and is the highest-ranking military official to be tried for acts of genocide committed during Guatemala’s 36-year civil war. This is the first genocide case in Latin America to be tried in national courts.

Caminando hacia la justicia

La sociedad guatemalteca hoy es testiga de un hecho histórico, por primera vez en nuestro país, el Ministerio Público presenta una acusación por el delito de genocidio contra un general retirado del ejército. Este paso hacia la justicia es de suma importancia para las miles de personas sobrevivientes del genocidio en Guatemala.

La acusación contra el general Héctor Mario López Fuentes, responde a lo establecido por la Jueza que preside el Juzgado Primero de Primera Instancia Penal, de Mayor Riesgo, quien desde junio ordenó este trámite.

Es importante mencionar que el sindicado ha interpuesto tres recursos que buscan dejar sin efecto lo actuado por la honorable Jueza, sin embargo, los mismos fueron rechazados por la Sala Primera de la Corte de Apelaciones del Ramo Penal, Narcoactividad y Delitos contra el Ambiente de Guatemala, que confirmó lo actuado por la titular del tribunal de Mayor Riesgo.

Apreciamos positivamente lo actuado por la Sala Primera de la Corte de Apelaciones y esperamos que si la defensa del militar apela a otras instancias, éstas actúen apegado a derecho y tomando en cuenta lo ya resuelto.

Consideramos que los recursos interpuestos por la defensa del general López Fuentes, solamente pretenden obstaculizar el proceso sin que haya una negación de la comisión de los hechos imputados; más bien la defensa del general retirado busca retardar el avance de la justicia como estrategia utilizada por otros sindicados de violaciones de derechos humanos.

La acusación presentada hoy envía un mensaje de esperanza en la justicia a quienes aún padecen las consecuencias del conflicto armado interno. También a los autores materiales e intelectuales de los graves delitos de lesa humanidad y genocidio que se cometieron en ese período, ya que no pueden quedar en la impunidad el genocidio, las ejecuciones extrajudiciales, la desaparición forzada, la violencia sexual y las masacres, entre otras violaciones.

Como lo marca el Calendario Maya, hoy día Q'anil se tiene la oportunidad de sembrar justicia, es el día para ofrendar esta semilla de esperanza en la justicia. Reiniciar el camino, un camino de memoria, verdad y justicia, que ofrece bases sólidas para la construcción de un país más justo. Esperamos que el caso continúe tramitándose conforme lo establece la ley y pronto podamos tener un juicio contra quienes ordenaron el genocidio en Guatemala.

Walking towards justice

Today Guatemalan society is witness to an historic event. For the first time in our country, the Attorney General presented an accusation for the crime of genocide against a retired army general. This step towards justice is of utmost importance for thousands of survivors of genocide in Guatemala.

The accusation against General Héctor Mario López Fuentes is a follow up to the indictment presented by the presiding Judge of the First Sentencing Court for High Risk Crimes, who in June ordered these proceedings.

It is important to note that the defendant has given three notices of appeal, which seek to render null and void the procedural actions already ordered by the honorable judge. However, those same notices of appeal were rejected by the First Chamber of the Criminal Appeals Court for Narco-trafficking and Crimes against the Environment, reinforcing the decision made by the presiding judge of the Court for High Risk Crimes.

We are appreciative for the actions taken by the Criminal Appeals Court and hope that if other appeals are made by the ex-general’s defense, that these former rejections will be taken into account and respected in observance of law.

We consider the notices of appeals submitted by the defense to only serve in hindering the legal process without allowing for any negation by those who are pressing charges, and that the retired general’s defense seeks to slow down the advance of justice; a strategy which has been utilized by others who have been accused of human rights violations.

The accusation presented today sends a message of hope in justice to all those who still suffer the consequences left behind from the internal armed conflict. Also to the material and intellectual authors of the genocide and crimes against humanity committed during this time period, a message is sent saying that genocide, extrajudicial executions, forced disappearance, sexual violence and massacres, among other violations, will not remain in impunity.

Today, the day Q’anil according to the Mayan calendar, marks the opportunity to sow justice. It is the day to make as an offering this seed of hope in justice, to start on a path of memory, truth and justice which will provide a solid base for the construction of a more just country. We are hopeful that this case will continue on its course according to law and that soon there will be a final judgment against those who ordered genocide in Guatemala.

FREDEMI Denounces Intimidation - FREDEMI denuncia persecución

FREDEMI: Public denunciation of the persecution against defenders of land and collective rights: the persecution of Gregoria Crisanta Pérez

On Wednesday August 31st at approximately 3:30 pm in San Miguel Ixtahuacán, Ms. Gregoria Crisanta Pérez was leaving the village of Máquivil on her way to her home in the village of Ágel. On her way, she observed a car from the official political party, UNE, as well as a dark green car with stripes following closely behind as part of the party caravan. This car is well known as belonging to the Mejia family.

The car appeared to be headed to the car workshop “General Mechanics and Maintenance of All Types” located on the side of the road that connects the village of Máquivil to that of San Miguel Ixtahuacán. In that moment, Gregoria Crisanta Pérez entered the Aguilar Transport bus headed to the San Antonio intersection. Once there, Ms. Perez waited for a taxi to go to the village of Ágel where she resides. While she waited for the taxi, the same dark green car belonging to the Mejia family reappeared. Ms. Crisanta then continued to her cousin’s house that is located just south of this intersection. When Crisanta turned to look to see if the car had left, she saw that the car continued in her direction. Gregoria Cisanta then headed towards nearby cornfields to hide herself until the car had left. She remained hidden in the cornfield for approximately 20 minutes. When she left the corn field she saw that the car was still there. Ms. Pérez then walked towards her friend Maria Yoc’s house, approximately 1 kilometer away. Once there, she stayed at the house for about half an hour to ensure her own safety. The fact that this car was following her is evidence of persecution.

This incident also reflects a current context of violence and political intimidation against individuals engaged in the defense of the territory of San Miguel Ixtahuacán as they denounce the ongoing human rights violations committed by Goldcorp’s subsidiary Montana Exploradora, in spite of the ongoing Precautionary Measures issued by the Inter American Commission on Human Rights of the Organization of the American States. Further, this occurrence is worrying given that the elections of September 11th are fast approaching, in which a key debate among political parties will relate to whether Goldcorp’s and Montana’s operations should continue in San Miguel Ixtahuacán or not.

In light of this, we urge regional and national authorities as well as the international community to observe and demand that the state of Guatemala put a stop to the impunity of human rights violators and the intimidation and violence against human rights defenders en San Miguel Ixtahuacán.

FREDEMI: Denuncia pública a la persecución de defensores del territorio y derechos colectivos: la persecución de Gregoria Crisanta Pérez

El Miércoles 31 de agosto a aproximadamente las 3:30 de la tarde en San Miguel Ixtahuacán, Doña Gregoria Crisanta Pérez estaba saliendo de la aldea Máquivil en camino a su casa en la aldea Ágel. En ese trayecto, observó el carro oficial del partido UNE y también un carro verde oscuro con rayas, parte de la caravana que seguía al Partido oficial. Este vehiculo es bien conocido como perteneciendo a la familia los Mejías.

El carro aparentemente se dirigió al taller de Mecánica en General y Mantenimiento de Todo Tipo ubicado a la oriya de la carretera que conduce de la aldea Máquivil a San Miguel Ixtahuacán. En ese momento, Gregoria Crisanta Pérez entró en el bus llamado transportes Aguilar para llegar al crucero San Antonio. En este lugar, Doña Pérez se quedó esperando un taxi para ir a la aldea Ágel, lugar de su residencia. Mientras esperaba el taxi, nuevamente apareció el mismo carro verde perteneciendo a la familia Mejía. Doña Crisanta entonces se dirigió a la casa de su primo, que se encuentra ubicado al sur de este crucero. Cuando Crisanta se volteó a ver si se había ido el carro, el carro seguía en la dirección hacia ella. Entonces Gregoria Crisanta se dirigió al terreno con sembrado de milpa para esconderse hasta que se fuera el carro. Se quedo debajo de la milpa por unos 20 minutos. Cuando salió de la milpa todavía estaba ahí el carro. Doña Gregoria Crisanta entonces siguió en camino para la casa de su amiga María Yoc a un kilometro de donde ella estaba. Ahí se quedo por una media hora para resguardar su seguridad. El seguimiento de este vehículo es evidencia de una persecución.

Este incidente también refleja un ambiente de intimidación y violencia política contra individuos en defensa del territorio de San Miguel Ixtahuacán ante las reclamaciones de las violaciones cometidos por la empresa minera Montana exploradora a pesar de la vigencia de las medidas cautelares otorgadas por la Comisión Interamericana de Derechos Humanos de los Estados Americanos, Además, esta ocurrencia es preocupante dado que se acerca las elecciones del 11 de Septiembre en que uno de los temas de los programas políticos más discutidos en la región es si se debería de continuar las operaciones de la empresa minera Montana de Goldcorp en San Miguel Ixtahuacán o no.

Por tanto, exigimos a las autoridades regionales, nacionales y a la comunidad internacional que observen y demanden al estado de Guatemala para que pare la impunidad de violadores de derechos humanos y que pare la intimidación y violencia contra los defensores de los derechos humanos en San Miguel Ixtahuacán.

Vecinos de Santa Cruz Chinautla denuncian eco-etnocidio

En una conferencia de prensa el 1 de septiembre, 2011, miembros del Comité Comunitario de Desarrollo -COCODE- del municipio de Santa Cruz Chinautla, acompañados de vecinos y vecinas mujeres, hombres, jóvenes y de tercera edad, denunciaron ante la comunidad nacional e internacional la situación de degradación ambiental en la cuenca del río Chinautla, así como la falta de acciones contundentes por parte de las autoridades al respecto. Ubicado río abajo del basurero más grande de la ciudad capital de Guatemala, el municipio de Santa Cruz Chinautla se vio fuertemente afectado por el paso de la tormenta Ágatha, a finales de mayo, 2010, así como por las intensas lluvias de finales de agosto, 2011. A continuación se reproduce el Comunicado Urgente: Emergencia en Santa Cruz Chinautla "Eco-Etnocidio".

El pueblo Poqomam de Santa Cruz Chinautla actualmente esta sufriendo los desastres provocados por las crecidas del río Chinautla. Este ha sido convertido en río de aguas negras y arrastra enormes cantidades de basura, destruyendo viviendas e inundado extensas áreas dejando a numerosas familias sin casa, expuestos a múltiples enfermedades infecciosas. Lamentamos también la muerte de la niña Adriana López arrebatada por una correntada de basura y aguas negras el lunes 22 de agosto de 2011.

A la opinión pública nacional e internacional denuncia:

1. Que nuevamente Santa Cruz Chinautla, sufre el impacto de las crecidas del río Chinautla hoy convertido en río de aguas negras por la nefasta administración de las municipalidades de la ciudad de Guatemala, Chinautla y Mixco.

2. Que el mal llamado relleno sanitario municipal, ha contribuido a la contaminación de la cuenca del río Chinautla drenando lixiviados y desechos sólidos que son arrastrados por las correntadas en la época de invierno, a esto contribuye el crecimiento desordenado de la ciudad y el municipio de Mixco, cuyos habitantes al no contar con un servicio de manejo y disposición de desechos sólidos, utiliza los barrancos que son parte del sistema de la cuenca como basureros clandestinos sin que las municipalidades mencionadas hagan algo por evitarlo.

3. El colapso de la red de drenajes de la capital, en particular el colector poniente. causante de grandes hundimientos en la zona 6 y zona 2, ha contribuido a los desastres que han golpeado al pueblo de Santa Cruz Chinautla, aumentando el caudal convirtiéndolo en un rio de aguas negras causando enormes daños como perdida de casas, de bienes y de vidas.

4. Las empresas areneras que han sido autorizadas por el Ministerio de Ambiente y Recursos Naturales-MARN y el Ministerio de Energía y Minas-MEM, han contribuido a este desastre provocando deforestación y alteración de las laderas de la cuenca.

5. El estado de Guatemala y las autoridades municipales, no han hecho nada para prevenir estos desastres, y por omisión son responsables de estar cometiendo un acto de discriminación y racismo en contra del pueblo Poqomam, por permitir el deterioro de la cuenca y sus ecosistemas permitiendo la extracción de arena, el vertido de contaminantes industriales y aguas negras a una de las cuencas tributaria del Río Motagua que también está condenado por la contaminación.

Ante esto:

1. Demandamos al Estado de Guatemala, a las municipalidades de Guatemala, Chinautla y Mixco, que en cumplimiento del mandato constitucional de garantizar la vida y la salud del pueblo Poqomam de Santa Cruz Chinautla, tomen medidas urgentes para el contrarrestar desastre construido históricamente por la deficiente administración de la municipalidad de Guatemala y por la falta de aplicación de las leyes ambientales del país.

2. Al Ministerio Público que en defensa de los derechos de los vecinos afectados inicie los procesos pertinentes, a fin de que se establezca la responsabilidad de los causantes de este desastre, se les aplique la ley y se proceda a la reparación de los daños causados.

3. A la Procuraduría de Derechos Humanos actuar en la protección de derechos del pueblo de Santa Cruz Chinautla.

4. Pedimos al pueblo de Guatemala su solidaridad, solicitamos su apoyo para que se exija el cumplimiento al derecho humano a la salud y a un ambiente sano exigiendo un plan de saneamiento para la ciudad capital y el municipio de Chinautla, el cierre del Basurero de la zona 3, la reparación y mantenimiento de los colectores capitalinos, la construcción de plantas de tratamiento para las aguas negras y planes pertinentes de manejo de las cuencas.

5. A la prensa nacional e internacional, visibilizar y documentar esta situación para que se tome conciencia de la situación por la que atraviesa el pueblo Poqomam.

6. Pedimos a las iglesias de Guatemala elevar sus oraciones para que las autoridades cumplan con sus funciones y ejerzan su trabajo para el bienestar del pueblo Poqomam.

7. A la comunidad internacional, pedimos la observación del cumplimiento de los convenios de derechos humanos, violados e irrespetados por el Estado de Guatemala y actuar en defensa de los derechos del Pueblo Poqomam.

In a press conference September 1, 2011, members of the Community Development Committee--COCODE--of the municipality of Santa Cruz Chinautla, accompanied by women, men, youth and elders, denounced before the national and international community the degradation of the Chinautla river basin, a situation which they characterize as an eco-ethnocide against the Poqomam Maya People of Guatemala. Situated downriver from Guatemala City's largest landfill, Santa Cruz Chinautla was severely affected by tropical storm Agatha, at the end of May, 2010, as well as heavy rainfall at the end of August, 2011. The following is a translation of the Urgent Communication: Emergency in Santa Cruz Chinautla "Eco-Ethnocide."

The Poqomam People of Santa Cruz Chinautla is currently suffering a situation of disaster provoked by the swelling of the Chinautla river, which has become a river of sewage carrying large cuantities of trash, destroying homes and flooding homes, as well as leaving numerous families without homes, exposed to various infectious illnesses. We also lament the death of the young girl Adriana López, who was carried away in a current of trash and sewage on Monday, August 22, 2011.

To national and international public opinion we denounce:

1. That Santa Cruz Chinautla is once again suffering the impact of the rise in the level of the Chinautla river, which has become in the present day a river of sewage owing to the poor administration of the municipalities of Guatemala City, Chinautla and Mixco.

2. That the poorly-named sanitary municipal landfill has contributed to the pollution of the Chinautla river basin, leaching liquid and solid wastes which are carried by the current of the river during the rainy season. This situation is aggravated by the disorderly growth of the capital city and the municipality of Mixco, whose residents do not enjoy garbage collection and disposal services and so use the ravines which form part of the river basin as clandestine dumps while the aforementioned municipalities do nothing to intervene.

3. The collapse of the drainage system in the capital, particularly the western sewers, which has caused large sinkholes in zone 6 and zone 2, has contributed to the disasters that have battered Santa Cruz Chinautla, raising the level of the river and turning it into a river of sewage, causing enormous damage including the loss of homes, property, and lives.

4. The sand extraction companies which have been authorized by the Ministry of Environment and Natural Resources (MARN) and the Ministry of Energy and Mines (MEM), have contributed to this disaster, provoking deforestation and the alteration of the walls of the basin.

5. The Guatemalan state and the municipal authorities have done nothing to prevent these disasters, and in failing to act are responsible for committing an act of discrimination and racism against the Poqomam people, permitting the deterioration of the river basin and its ecosystems via the extraction of sand, the dumping of industrial pollutants and sewage into one of the tributary basins of the Motagua river, which is also condemned by the pollution.

In the face of this situation:

1. We demand that the Guatemalan state and the municipalities of Guatemala, Chinautla and Mixco, in compliance with their constitutional mandate to guarantee the right to life and health of the Poqomam People of Santa Cruz Chinautla, take urgent measures to halt the disaster historically constructed by the deficient administration of the municipality of Guatemala and by the lack of application of the nation's environmental laws.

2. We demand that the Attorney General's office, in defense of the rights of the citizens affected by these processes and in order that responsibility for the causes of this disaster be established, apply the law and proceed to the reparation of the damages caused.

3. We demand that the Human Rights Ombudsperson's Office act to protect the rights of the people of Santa Cruz Chinautla.

4. We ask that the Guatemalan people extend its solidarity, and we solicit its support in demanding the compliance of the human right to health and a healthy environment, appealing for a cleanup plan for the capital city and the municipality of Chinautla, the closure of the Zone 3 Dump, the repair and maintenance of the capital's sewers, the construction of a treatment plant for the sewage and plans for the management of the river basins.

5. We ask that the national and international media document this situation and make it visible, to raise awareness of the situation faced by the Poqomam People.

6. We ask Guatemala's churches to pray that the authorities carry out their obligations and work for the well-.being of the Poqomam People.

7. We ask of the international community its observance of the international human rights law violated and disrespected by the Guatemalan state, and that it act in defense of the rights of the Poqomam People.

Historica condena por masacre de Las Dos Erres

HISTORICA CONDENA
POR MASACRE DE LAS DOS ERRES

El Centro para la Acción Legal en Derechos Humanos, CALDH, manifiesta su complacencia ante la reciente condena de cuatro militares responsables de la masacre del Parcelamiento Las Dos Erres, Petén, en diciembre de 1982 en donde fueron asesinadas más de doscientas personas.

La sentencia condenatoria recoge elementos fundamentales para la historia del país, entre ellos: que la masacre fue debidamente planificada como parte de la política contrainsurgente que se implementaba en aquella época y representó un castigo y advertencia a los pobladores por la supuesta colaboración con la guerrilla quedando comprobado en el debate que la población de las Dos Erres se dedicaban a actividades agrícolas, no habiéndose encontrado armas en el lugar.

El tribunal reconoció que las violaciones sexuales cometidas contra mujeres y niñas de la comunidad dejaron en las sobrevivientes graves secuelas psicológicas que hasta la fecha padecen. Cabe resaltar que la condena impuesta a los kaibiles y al teniente fue por cada una de las personas que fueron masacradas en las Dos Erres, con lo que el Tribunal valora la vida de cada una de las víctimas que perecieron en la barbarie.

Expresamos nuestro reconocimiento al Honorable Tribunal Primero de Sentencia Penal de Alto Impacto integrado por las abogadas Patricia Bustamente, Jasmín Barrios y el abogado Pablo Xitemul, quienes han actuado apegado a derecho y respetando la legislación nacional e internacional. Reconocemos también la labor realizada por la Fiscal y los Fiscales del Ministerio Público que tuvieron a su cargo este caso.

Manifestamos nuestra admiración y reconocimiento a las mujeres y hombres familiares y sobrevivientes de la masacre de las Dos Erres, quienes han perseverado para alcanzar justicia, su ejemplo nos anima a continuar en la lucha. Asimismo, a la Asociación de Familiares de Detenidos Desaparecidos de Guatemala, FAMDEGUA, quienes han acompañado este caso con una incansable valentía.

Mediante la sentencia dictada, el Sistema de Justicia guatemalteco reconoce la gravedad de la masacre y da una luz de esperanza a las miles de familiares de víctimas y sobrevivientes del conflicto armado interno que aún esperan justicia. Juzgar los hechos del pasado es fundamental para garantizar que NUNCA MÁS se vuelvan a repetir estos crímenes que lastiman la dignidad de la humanidad entera.

Two Municipalities of Santa Rosa Say NO to Tahoe Resources and Metal Mining

In July, almost 13,000 residents from two municipalities in the department of Santa Rosa voted against all mining projects on their land. The municipalities are two of five in the department of Santa Rosa affected by the Escobal project, a silver deposit owned by Canadian company Tahoe Resources. Since 2005, more than 700,000 people throughout Guatemala have democratically voted NO to large-scale development projects, such as mining and hydroelectric dams, in more than 60 community referendums.

First Referendum in Santa Rosa: 98.87% say NO to Chemical Metal Mining

On July 3rd, 7,602 residents of the municipality of Nueva Santa Rosa participated in the community referendum. The press release by CODIDENA (Consejo Diocesano de Defensa de la Naturaleza Santa Rosa, Guatemala), Lideres Principales Hablando del Pueblo Xin-Ka, the Colectivo Ecologista MadreSelva, CALAS, and WAQIB’ Kej stated: “The consultation convened by the City Council at the request of residents of the municipality, gave a result that clearly reflects the NO to mining and YES to Life, with 98.87% voting “No” and 1.13% voting “Yes.”

Second Referendum in Santa Rosa: 98.34% Say NO to Chemical Metal Mining

A week later, on Sunday, July 10th, the neighboring municipality of Santa Rosa de Lima organized the second community referendum in the region. Late that evening, the mayor declared the municipality of Santa Rosa de Lima “Free of Chemical Metal Mining”. Of the 5,338 residents that participated, 98.34% voted “No” and 1.66% voted “Yes” to metal mining projects.

The Escobal Project and Tahoe Resources

Tahoe Resources acquired the Escobal project from Goldcorp in 2010. The founder, President and Chief Executive Officer of Tahoe Resources, Kevin McArthur, was CEO of Glamis Gold and Goldcorp until 2008.

After acquiring the Escobal project, McArthur expected little opposition from the local population. In September 2010, during a presentation at the Denver Gold Conference, McArthur stressed that “The Escobal project is in a region that is receptive to the mining industry...We are not in the Guatemalan Mayan highlands; we are down in the southeast portion of the country. We will not have the indigenous issues that Marlin and some of the other mines in the country have had.”

With a third referendum underway in another municipality near the Escobal project, the population is demonstrating its opposition to metal mining based on rights defined in Guatemala's municipal code. Tahoe Resources lawyers have challenged the validity of this type of referendum.

Meet Minera San Rafael S.A., a subsidiary of Tahoe Resources

On July 9th, a day before the referendum, residents of almost every village of Santa Rosa de Lima found thousands of pro-mining materials, including materials promoting Tahoe Resources subsidiary, San Rafael S.A.

Pamphlet 2: "Nice to meet you, we are Minera San Rafael, S.A...If you have this informative text in your hands, it means you and your family are willing to give the development of Guatemala a chance."

Pro-mining propaganda is not new in the region. Transnational companies have spent large sums of money on publicity in mass media. In San Rafael Las Flores, Santa Rosa, the community tabloid Buenos Días has been published since October 2010:

El 27 de julio, 2011, se presentó en la Ciudad de Guatemala el estudio "Asuntos de Recuperación y Costos Aproximados para la Recuperación de la Mina Marlin". El documento representa el fruto de un ezfuerzo en conjunto entre la Comisión Pastoral Paz y Ecología -COPAE- y el Unitarian Universalist Service Committee -UUSC-, con el cual se pretende una aproximación a los gastos que le corresponderían a la compañía Montana Exploradora, filial de la canadiense Goldcorp, costear al cerrar la Mina Marlin, en San Marcos, en concepto de recuparación del deterioro ambiental provocado por la operación minera.

El dato resultante del estudio, que corresponde al conjunto de los montos correspondientes a diversos trabajos de recuperación y subsanación del medioambiente tales como el tratamiento de agua, el cierre de aperturas subterráneas, la cobertura y posterior reforestación del tajo abierto de la mina y el tratamiento de colas, entre otros, así como los costos adminidstrativos asociados a dichos trabajos, es de Q389,203,215, unos $50,000,000.

Los presentadores del estudio, los ingenieros estadounidenses especialistas en temas de minería Steve Laudeman, B.S., M.S., P.E. y Robert Robinson, E.M., M.S., M.E.M.P., P.E., refirieron que la fianza pagada por Montana Exploradora al Estado de Guatemala, es decir, la garantía cancelada por la empresa de antemano al gobierno con el fin de que éste no incurriría en pérdidas si la mina, por encontrarse en quiebra o por otro motivo, se cerrara, es de tan solo Q8 millones, más o menos $1 millón, un monto inferior a lo que costaría siquiera el desmantelamiento de los edificios y demás infraestructura perteneciente a la compañía minera.

Asimismo, aclararon que dentro del dato calculado de Q389 millones no se le pone precio al costo humano de la Mina Marlin, concepto que comprendería tanto los gastos médicos que pudieran tocarles pagar a las personas cuyas salud haya sido dañada por la actividad minera como el perjuicio cultural que la misma actividad pueda haberles ocasionado a los Pueblos que habitan en las cercanías de la mina. Los ingenieros presentadores dieron a conocer además que el dato no incluye el costo total del tratamiento de aguas que conlleva el cierre de una mina, ya que dicho trabajo no tiene final y debe seguir perpetualmente. Concretamente, el ingeniero Steve Laudeman puso como ejemplo que en el Estado de Colorado, Estados Unidos, se suele gastar unos $1 millon anualmente por el tratamiento de aguas contaminadas por operaciones mineras que fueron cerradas ya hace unos 100 años.

En representación de los municipios en donde los Pueblos Indígenas han realizado consultas comunitarias de buena fe, Chávez ha solicitado que la Corte de Constitucionalidad otorgue un amparo en contra de la actual propuesta del gobierno central de reglamentar las consultas comunitarias. Denunció que se percibe una complicidad entre el Gobierno y las empresas transnacionales, y observó que "Es evidente que las relaciones de poder del sistema no están a favor de las comunidades, nunca han estado, y ni van a estar". Haciendo referencia a la fianza pagada por la empresa Montana Exploradora al Estado, declaró que ". . . da risa pero también da cólera, porque realmente esta fianza no . . . cubre los daños hechos en la vida de la cultura, la economía, lo social y lo biológico".

On July 27, 2011, in Guatemala City, the study "Issues of Recuperation and Approximate Costs for the Recuperation of the Marlin Mine" was presented to the public. The document represents the fruit of a conjoined effort of the Pastoral Peace and Ecology Commission (COPAE) and the Unitarian Universalist Service Committee (UUSC), intended to approximate the costs which Montana Exploradara, a subsidiary of the Canadian company Goldcorp, would have to assume upon closing the Marlin Mine in San Marcos, in terms of recuperating the environmental damage provoked by the mining operation.

The figure resulting from the study, which corresponds to a set of costs corresponding to diverse recuperative and restorative tasks, such as water treatment, the sealing of underground openings, covering and later reforesting the mine's open pit and the treatment of tailings, among others, as well as the administrative costs associated with said tasks, is Q389,203,215, some $50,000,000.

The presenters of the study, U.S. engineers specializing in mining issues Steve Laudeman, B.S., M.S., P.E. and Robert Robinson, E.M., M.S., M.E.M.P., P.E., noted that the deposit paid to the Guatemalan government by Montana Exploradora, the guarantee paid beforehand in order that the government would incur no loss were the mine to close for bankruptcy or other reasons, totals Q8 million, roughly $1 million, which is less than it would cost even to dismantle the buildings and other infrastructure belonging to the mining company.

Likewise, they clarified that the Q389 million figure places no price on the human cost of the Marlin Mine, a concept which would conceptualize the medical costs that could be incurred by persons whose health may have been damaged by the mine's activities, as well as the cultural damage suffered by the Peoples living close to the mine. The engineers presenting the study also indicated that the figure does not include the total cost of water treatment involved, given that such treatment has no end and has to be continued perpetually. Concretely, engineer Steve Laudeman put forth as an example that in the State of Colorado, United States, some $1 million are spent annually for the treatment of water contaminated by mines that were closed some 100 years ago.

Along with the presenters of the study, Aura Lolita Chávez, representative of the Consejo de Pueblos de Occidente (CPO), was present. Chávez declared that "As the Consejo de Pueblos de Occidente, we are observing the violent manner in which this transnational company, Goldcorp, enters our communities" and ratified that "In no way can we, the Original Peoples, the Ancestral Peoples, the men and women who have lived in harmony with Mother Nature, see this as development." She denounced that a complicity between the Government and transnational companies may be observed and stated that "It is evident that the power relations of the system are not in favor of the communities, never have been and never will." Making reference to the deposit paid to the State by Montana Exploradora, she declared that ". . . it's laughable but outraging, because the deposit really does not . . . cover the damages to life in terms of culture, the economy, the social and biological spheres."

History-making Dos Erres massacre trial begins: on-going coverage

More than 28 years have passed since the massacre of more than 250 men, women, and children in the small farming community of Las Dos Erres, Petén. For 17 years, survivors and family members of victims have struggled to bring the perpetrators to justice, with the support of the Guatemalan Association of Families of the Detained and Disappeared (FAMDEGUA). Yesterday, July 25, those efforts led to the opening of a criminal trial against four Guatemalan ex-military, who stand accused of crimes against humanity and the murders of at least 201 people.

Of the accused, Manuel Pop Sun, Reyes Collin Gualip, and Daniel Martínez Mendez were trained and served as instructors at the training academy for the infamous "Kaibil" special forces of the Guatemalan military. According to the prosecution, they served in an elite mobile task force which committed the massacre in Las Dos Erres in December of 1982. The other accused, Carlos Antonio Carías López, was at the time the commanding officer of the nearby military base in Las Cruces, Petén; Carías is also charged with aggravated robbery, with survivors and family members of victims accusing him of the theft of land and property from the village following the massacre.

On the first day of the trial, each of the accused delivered preliminary statements and underwent cross-examination, all denied participation in the massacre. The court heard six witnesses presented by the prosecution, including two ex-Kaibiles who gave testimony of their own roles in the massacre, placing Pop Sun, Gualip, and Mendez at the scene and describing the acts of brutality committed by the elite commando unit. Serving as protected witness, the ex-Kaibiles gave their testimony via video link in Mexico; both originally approached the UN Mission in Guatemala and FAMDEGUA in the mid 1990s to confess their participation in the massacre. When asked why he agreed to testify, one of the ex-Kaibiles said, "Because many families need it, they must know the truth."

The other four witnesses, all family members of those killed in the massare, included a woman who worked as a schoolteacher in the village, and had left the community for her holiday vacation at the time of the massacre; and a man who was 14 at the time, and along with other family lost two young sisters who had gone to visit an aunt in the village on the day of the massacre. All the witnesses agreed that the elite Kaibil force encountered no resistance during their operation in the community, and that the villagers of Las Dos Erres were poor farmers with no links to insurgent forces.

The trial continued today, July 26, with the testimony of some 20 witnesses for both the prosecution and defense. Among witnesses for the prosecution was Ramiro Osorio Cristales, who as a 5-year-old survived the massacre and was kidnapped and raised as a servant by one of the Kaibil soldiers. The trial is expected to continue possibly through the end of July.

In addition to those currently on trial, the ex-Kaibil Gilberto Jordán is serving 10 years of prison in the United States for immigration fraud, having lied about his past as a soldier and his participation in the massacre on his U.S. citizenship application. Another ex-Kaibil, Santos López Alonzo, is also detained in the United States by immigration authorities, and has given details of his own participation in the massacre.

Recently, the ex-Kaibil Pedro Pimentel Ríos was deported from the United States as an undocumented immigrant; he is currently detained in Guatemala and proceedings are advancing for a separate trial against him for his role in the massacre. During Monday's testimony, one of the ex-Kaibil witnesses presented by the prosecution described how Pimentel Ríos left Guatemala via helicopter shortly after the massacre in order to attend the U.S. military-sponsored School of the Americas in Panamá.

A fourth ex-Kaibil, Jorge Sosa Orantes, is detained in Canada waiting an extradition hearing in August to determine whether he will be tried in the U.S. for immigration fraud, or in Guatemala, Spain, or Canada for crimes against humanity.

Dear friends,

On February 20, 2011, our friend Victor Leiva, artist and founding member of the collective Caja Ludica, was taken from us. Victor was shot to death while leaving his work in the Historical Center of Guatemala City, in circumstances which have not been clarified.

We are requesting signatures for a letter addressed to the Guatemalan Public Prosecutor’s Office urging that an exhaustive investigation be carried out to identify and hold accountable those responsible for Victor’s death.

Dear Attorney General,

Today, Víctor Leiva would have turned 25 years old. Víctor – known as “el mono” (“the monkey”) – was an artist, promoter of culture, and founding member of the collective Caja Lúdica. Victor was a stiltwalker, a dancer, and he participated in theater and performance art. He was also a teacher in the dance organization Trasciende (“Transcend”). A friend described him as follows:

“He was a great person, he was always very affectionate, very happy, outraged by the reality of life in Guatemala, he had a great passion for creating artistic processes, we remember him as a companion – happy, full of life, and irreverent.”

However, 6 months and one day ago, on February 3rd, 2011, he was shot to death as he left his work in the Historic Center of Guatemala City, in circumstances that still have not been clarified.

This terrible act of violence generated a wave of indignation and rejection in Guatemalan civil society, and was denounced by various artistic organizations, as well as national and international human rights organizations.

We, the undersigned, ask that you carry out an exhaustive and efficient investigation as soon as possible; in order to identify, bring to trial, and sentence those responsible for the violent death of our companion and friend, Víctor Leiva.

El 2 de febrero del 2011 quitaron la vida de nuestro amigo Víctor Leiva, artista, promotor cultural y miembro fundador del colectivo Caja Lúdica. Víctor fue asesinado por arma de fuego cuando salía de su trabajo en el Centro Histórico de la Ciudad Capital, por circunstancias que hasta hoy no han sido esclarecidas.

El día de hoy, Víctor Leiva hubiera cumplido 25 años. Víctor –conocido como “el mono”– era artista, promotor cultural y miembro fundador del colectivo Caja Lúdica. Víctor actuaba con zancos, era bailarín y también participaba en obras de arte. Asimismo, fungía como maestro de la organización Trasciende que se dedica a la danza. Una persona quién lo conoció lo describió así:

“Era una gran persona, siempre fue una persona muy amorosa, muy alegre, indignada por la realidad y con una gran pasión por realizar procesos artísticos, lo recordamos como un compañero, alegre, lleno de vida e irreverente”.

Sin embargo, hace 6 meses y un día, el 3 de febrero del 2011, fue asesinado por arma de fuego cuando salía de su trabajo en el Centro Histórico de la Ciudad Capital, por circunstancias que aún no han sido esclarecidas.

Este lamentable hecho de violencia generó una ola de indignación y rechazo entre la sociedad civil guatemalteca, y fue denunciado por numerosas organizaciones artísticas y de derechos humanos nacionales e internacionales.

Las y los firmantes de la presente carta nos dirigimos a usted, solicitando que se realicen en la mayor brevedad las investigaciones exhaustivas y eficaces necesarias para que se identifique, juzgue y sancione a los responsables de la muerte violenta de nuestro compañero y amigo Víctor Leiva.

PRONUNCIAMIENTO PÚBLICO DE LOS PUEBLOS MAM Y KICHE' DEL DEPARTAMENTO DE QUETZALTENANGO, GUATEMALA

Los municipios del área Mam del departamento de Quetzaltenango: Huitán, Cajolá, San Miguel Siguila, San Juan Ostuncalco, San Martin Sacatepéquez, Concepción Chiquirichapa, miembros del Consejo Maya Mam, Consejo Mayor Mam de Guatemala, y el pueblo kiche del municipio de Olintepeque, somos miembros del Consejo de Pueblos de occidente CPO. A la opinión pública nacional e internacional manifestamos.

Como prácticas de nuestros valores y respeto integral colectivo hacia nuestros pueblos hemos realizado consultas comunitarias de buena fe, en nuestros municipios, donde manifestamos nuestro rechazo rotundamente a la exploración y explotación minera, hidroeléctrica y mega proyectos, que pretenden imponer en nuestros territorios, constituye una nueva forma de invasión como hace 518 años.

El nombre del falso "Desarrollo" que los sucesivos gobiernos en complicidad con empresas nacionales e internacionales nos prosentan, solo son una forma clara de despojo de nuestros bienes naturales, aprovechándose del empobrecimiento y la falta de información hacia nuestros pueblos, nos enfrentan y nos dividen entre hermanos.

Hemos venido a confirmar nuestra decisión y posicionamiento político, el derecho a la libre determinación sobre nuestros territorios como pueblos originarios; ratificando que las consultas comunitarias, constituyen un principio ancestral de participación y toma de decisiones de acuerdo a nuestras costumbres y tradiciones, reconocidas por las leyes nacionales y convenios internacionales.

Al gobierno de Guatemala exigimos respeto a la voluntad de nuestros pueblos, expresadas en las consultas comunitarias.

Exigimos al gobierno de turno y a los próximos, la implementación de un nuevo modelo económico, en armonía con la naturaleza y que respete la cosmovisión y demandas legítimas de nuestros pueblos originarios.

Exigimos a la Corte de Constitucionalidad, otorgar el amparo definitivo que frene la intención del gobierno y algunos sectores irresponsables, [de] reglamantar el proceso de Consultas Comunitarias, lo cual constituye para nosotros una clara intención de descalificar la decisión de 57 municipios que han realizado sus consultas comunitarias, así como confundir y restringir el espíritu y nuestros derechos de consulta.

PUBLIC DECLARATION OF THE MAM AND KICHE' PEOPLES OF

THE DEPARTMENT OF QUETZALTENANGO, GUATEMALA

The municipalities of the Mam territory of Quetzaltenango: Huitán, Cajolá, San Miguel Siguilá San Juan Ostuncalco, San Martín Sacatepéquez and Concepción Chiquirichapa; members of the Maya Mam Council of Guatemala (Consejo Maya Mam de Guatemala), the Mam High Council of Guatemala (Consejo Mayor Mam de Guatemala), and the Kiche' People of the municipality of Olintepeque, are members of the Council of Peoples of the West (Consejo de Pueblos de Occidente CPO). To the national and international public opinion, we manifest:

As a practice of our values and a fundamental respect towards our Peoples, we have carried out good faith community referenda in our municipalities, in which we have manifested our resounding rejection of the mining exploration and exploitation, hydroelectric plants and other megaprojects intended for our territories. These projects constitute a new form of invasion like that which took place 518 years ago.

The false "Development" that successive governments present to us, in complicity with national and international companies, is nothing more than a clear form of dispossession of our natural resources which takes advantage of our impoverished condition and the lack of information of our peoples; it turns us on one another and divides our brothers.

We have come to confirm our decision and political position, our right to self-determination with regards to our territories as indigenous peoples; we ratify that community referenda constitute an ancestral principle of participation and decision-making, in accordance with our customs and traditions, recognized by national laws and international conventions.

To the Guatemalan government, we demand respect for the will of our peoples as expressed in our community referenda.

We demand that this government and those that are to come implement a new economic model, in harmony with the natural environment and which respects our cosmovision and the legitimate demands of original Peoples.

We demand that the Constitutional court grant a definitive injunction halting the attempt by the government and some irresponsible sectors to regulate community referenda, which represents to us a clear attempt to disqualify the decision of 57 municipalities that have carried out their own community referenda , as well as to confuse and restrict the spirit of referenda and the rights associated with their carrying out.

We call on the Guatemalan People in general and the international community to join with us and, in solidarity, to assert our legitimate rights and to construct a new model of life in which all may live well.

Guatemala observa el Día Nacional Contra la Desaparición Forzada

El 21 de junio del 2011, en distintas actividades realizadas en la Ciudad de Guatemala, familiares de las víctimas, activistas y otros se congregaron en honor a los más de 45,000 desaparecidos de la guerra civil de Guatemala, así como para conmemorar a los incontables desaparcidos en conflictos a lo largo y a lo ancho del mundo. En esta fecha se cumple el 31 aniversario de la desaparición forzada colectiva de 27 sindicalistas de la Central Nacional de Trabajadores.

En la mañana del 21 de junio, el Grupo de Trabajo contra la Desaparición Forzada en Guatemala llevó a cabo una conferencia de prensa frente al Congreso, observando el Día Nacional Contra la Desaparición Forzada con pedir que se apruebe la Iniciativa de Ley 3590. La Initiativa propone que se establezca una Comisión de Búsqueda para las personas que fueron desaparecidas durante el conflicto armado interno. Presentada al Congreso por primera vez en noviembre del 2005, la propuesta de ley cuenta con el respaldo de la Comisión Interamericana de Derechos Humanos, el Grupo de Naciones Unidas Contra la Desaparición Forzada, y el Comité Internacional de la Cruz Roja. El Grupo de Trabajo lamentó que, a pesar de haberse reunido más de 150 veces con legisladores y legisladoras tanto de la presente legislatura como de la pasada, para darles a conocer la importancia de la ley, hasta la fecha, el Congreso no ha asumido el compromiso de ocuparse de su ratificación.

The date marks the 31st anniversary of the collective forced disappearance of 27 unionists from the National Workers Union (Central Nacional de Trabajadores).

In a commemorative activity in the plaza billed "45,000 reasons to continue in the struggle," participants symbolically released white balloons with the words "If you see this, I want you to know that we are still waiting for you."

On the morning of June 21, the Working Group against Forced Disappearance in Guatemala held a press conference in front of the national Congress, marking the National Day against Forced Disappearance by asking for Initiative 3590 to be passed into law. The Initiative proposes to establish a Search Commission for people who were disappeared during the armed internal conflict. Originally presented to Congress in November of 2005, the proposed law has the support of the Inter-American Commission for Human Rights, the United Nations Working Group against Forced Disappearance, and the International Committee of the Red Cross. The working group lamented that, in spite of having met more than 150 times with legislators in both the current and previous legislature to explain to them the importance of the proposed law, to date, the Congress has failed to assume the commitment of seeing to its ratification.

Después de la captura del militar retirado General Héctor López Fuentes el viernes pasado, ayer una audiencia ligó formalmente el ex-Jefe Mayor del Ejército al proceso judicial para los crímenes de genocidio, deberes contra la humanidad y desaparición forzada. Hoy representantes de la Asociación para la Justicia y Reconciliación (AJR), una organización de sobrevivientes del genocidio, compartieron el comunicado abajo juntos con su asesoría legal Centro para la Acción Legal en Derechos Humanos (CALDH).

UNA OPORTUNIDAD HISTÓRICA
PARA LA JUSTICIA GUATEMALTECA

Juzgar el genocidio y garantizar que no se repita.

Después de 28 años de impunidad en los delitos de lesa humanidad y genocidio cometidos durante el conflicto armado interno en contra del pueblo maya, la Jueza Carol Patricia Flores deja ligado a proceso a uno de los autores intelectuales del genocidio, el general Mario López Fuentes, quien fungió como Jefe del Estado Mayor General del Ejército, del 23 de marzo del 82 al 21 de octubre del 83, en el gobierno de Efraín Ríos Montt.

En el año 2001, las víctimas sobrevivientes del genocidio interpusieron una querella contra el alto mando militar de 1982-1983 integrado por el Jefe de Estado, Efraín Ríos Montt, el Ministro de la Defensa General, Oscar Humberto Mejía Víctores y el General Héctor Mario López Fuentes. Después de casi diez años, el Ministerio Público ha culminado con la investigación de dicho caso y solicita la orden de captura de uno de los implicados, dándose exitosamente y quedando éste ligado a un proceso judicial.

Manifestamos nuestra complacencia por este hecho que demuestra que en Guatemala se ha logrado crear condiciones para juzgar graves violaciones a los derechos humanos cometidas durante el conflicto armado, entre otras, existen funcionarios públicos que no se dejan intimidar por estructuras ligadas a dichos crímenes que pretenden que los mismos queden en la impunidad, asimismo las instituciones encargadas de la persecución penal tienen la voluntad de actuar. Esperamos que el resto del proceso continúe con actuaciones como estas que fortalecen el estado de derecho en nuestro país.

Para los familiares de las víctimas y sobrevivientes del conflicto armado, este hecho representa una esperanza que anima a continuar en la lucha por la verdad y la justicia. Significa una oportunidad histórica para el sistema de justicia guatemalteco que puede romper con la impunidad y demostrarle al mundo entero que somos un país que cumple con su legislación y la normativa internacional en materia de derechos humanos.

La justicia es el pilar fundamental que garantiza la no repetición de los hechos violentos. Ahí radica la urgente necesidad de aplicar la justicia, no solo para los crímenes del pasado, sino también del presente. Nuestro presente es el claro ejemplo de lo que pasa cuando las estructuras que operaron en el pasado no se desmantelan y por el contrario afianzan su operar.

Hoy, Guatemala dio un paso adelante en un caso emblemático para el país, demandamos que el Estado responda apegado a derecho a la solicitud de justicia. El Estado tiene esa deuda con las víctimas y sobrevivientes del conflicto armado interno. Exhortamos a todos los guatemaltecos y guatemaltecas que padecieron las graves violaciones a los derechos humanos en el conflicto armado interno a continuar rompiendo el silencio, a decir la verdad de lo ocurrido, construir nuestra memoria colectiva y exigir JUSTICIA.

After the arrest and capture of retired general Héctor López Fuentes on Friday, proceedings yesterday officially indicted former Army Chief of Staff for the crimes of genocide, crimes against humanity and forced disappearance. Representatives of the Association for Justice and Reconciliation (AJR), an organization of survivors of genocide, joined their legal advisors from the Center for Human Rights Legal Rights Action (CALDH) to issue the statement below.

FOR JUSTICE IN GUATEMALA

Prosecute genocide and guarantee it is not repeated

After 28 years of impunity for crimes against humanity and genocide committed during the internal armed conflict against the Maya people, Judge Carol Patricia Flores formally indicted one of the authors of genocide – General Mario López Fuentes, who acted as army chief of staff from March 23, 1982 until October 21, 1983 in the government of Ríos Montt.

In 2001, surviving victims of genocide submitted a complaint against the military high command of 1982-1983, made up of Head of State, Efraín Ríos Montt; Minister of Defense, Oscar Humberto Mejía Víctores and General Héctor Mario López Fuentes. After almost 10 years, the Attorney General has completed the investigation of this case and requested an arrest warrant for one of those implicated. This was successfully carried out and he [López Fuentes] now remains formally linked to a judicial process.

We express our satisfaction with these events, which demonstrate that Guatemala has been able to create the conditions within which to prosecute grave violations of human rights committed during the armed conflict. Among other conditions, there are today public servants who do not allow themselves to be intimidated by structures linked to the aforementioned crimes and which work to maintain those crimes in impunity. Likewise, the institutions in charge of prosecuting crimes have the will to act. We hope that the rest of the process will be characterized by actions like these, which bolster the rule of law in our country.

For the family members of the victims and survivors of the armed conflict, this event represents a hope that motivates us to continue in the struggle for truth and justice. It signifies an historic opportunity to break with impunity and demonstrate before the entire world that we are a country that complies with domestic legislation and international norms regarding human rights.

Justice is the fundamental key that guarantees that violent acts will not be repeated. This is the basis of the necessity of applying justice, not just for past crimes, but also for crimes committed today. Our present day situation [in Guatemala] is a clear example of what happens when structures that operated in the past are not dismantled and, to the contrary, consolidate their operation.

Today, Guatemala took a step forward in an emblematic case for the country; we demand that the State serve justice in accordance with the law. We exhort all Guatemalans who suffered the grave human rights abuses that occurred during the internal armed conflict to continue breaking the silence, to tell the truth of what happened, to construct a new collective memory and to demand JUSTICE.

El 20 de junio del 2011, el General retirado Héctor Mario López Fuentes fue formalmente acusado de genocidio, crímenes de lesa humanidad y desaparición forzada. Como jefe del Estado Mayor del Ejército bajo el régimen de facto de Efraín Ríos Montt, a López Fuentes se le imputa de ser el responsable de la elaboración y la ejecución de operaciones militares, incluyendo el Plan Victoria '82, el Plan Firmeza '83 y el Plan Operación Sofía, bajo el marco de las cuales se le definió a la población civil de étnia Maya Ixil como enemigo interno, suponiéndola base de apoyo al movimiento guerrillero y convirtiéndola así en blanco del ejército. Pruebas incluyendo planes militares, evidencias forénsicas recogidas de fosas clandestinas y peritaje experto sobre el funcionamiento de fuerzas militares latinoamericanas fueron presentadas. También se entregaron numerosos testimonios de sobrevivientes de las campañas de tierra arrasada del ejército en los municipios de Nebaj, Chajul, y Cotzal, área denomidado el Triángulo Ixil por las fuerzas armadas de Guatemala.

Los principales querellantes en el caso son la Asociación para la Justicia y Reconciliación (AJR) y el Centro para la Acción Legal en Derechos Humanos (CALDH). On June 20, 2011, retired General Héctor Mario López Fuentes was indicted for genocide, crimes against humanity and forced disappearance. As Army Chief of Staff under the de facto regime of General Efraín Ríos Montt, López Fuentes is accused of being responsible for the elaboration and execution of military operations including Plan Victoria '82, Plan Firmeza '83 and Plan Operación Sofía, under which the civilian population of Maya Ixil ethnicity was defined as an internal enemy and targeted as the base of support of the guerrilla movement. Military plans, forensic evidence gathered from clandestine graves, and expert testimony on the functioning of Latin American militaries were presented as evidence. Also submitted were numerous testimonies from survivors of the military's scorched-earth policies in the municipalities of Nebaj, Chajul and Cotzal, called the Ixil Triangle by the Guatemalan military.

The primary plaintiffs in the case are the Association for Justice and Reconciliation (AJR) and Center for Human Rights Legal Action (CALDH). NISGUA has provided international human rights accompaniment for both the AJR and CALDH since the filing of the national genocide cases in 2000 and 2001.

La misma mañana, en la misma sala, inmediatamente previo a la comparencia de López Fuentess, otra audiencia se llevó a cabo de torno a la 1978 masacre de Panzós, reconocida como la primera masacre del período más oscuro de las compañas contrainsurgentes de "tierra arrasada" en Guatemala. Ex-Jefe Edil de Panzós Walter Overdick narro cómo campesinos Mayas Q'eqchíes fueron fusilados por el ejército en la plaza central de Panzós tras haberse manifestado a favor de sus derechos a la tierra y en contra del secuestro de líderes locales, y acusó a pudientes terratenientes de haberse coordinado con el ejército para reprimir el movimiento. El testimonio detallado de Overdick, de 74 años de edad, se incorporará a las pruebas en el procedimiento legal en curso. The same morning, in the very same court room immediately prior to López Fuentes' indictment, another hearing was held regarding the 1978 Panzós massacre, recognized as the first massacre of Guatemala's darkest period of "scorched earth" counterinsurgency. Former mayor of Panzós Walter Overdick related how Maya Q'eqchi' farmers were shot by the military in the town square of Panzós following a protest for land rights and against the kidnapping of local leaders, and accused powerful landowners of having coordinated with the military to repress the movement. The 74-year old Overdick's detailed testimony will be entered into evidence in the ongoing legal process. The surviving witnesses and family members of the more than 100 victims of the massacre are supported in their struggle for justice by the Association of Family Members of the Detained and Disappeared of Guatemala (FAMDEGUA). NISGUA also provides international human rights accompaniment to FAMDEGUA and participants in the Panzós case.

FIRST ARREST FOR GENOCIDE IN GUATEMALA

Today, June 17th, General Héctor Mario López Fuentes was captured in Guatemala City, twenty-nine years after having initiated the execution of Plan Victoria 82, developed by the Army Chief of Staff and Efraín Ríos Montt’s de facto government. He is accused of having perpetrated genocide against the Maya Ixil people in the years 1982-83.

The victims and survivors of genocide have knocked on the doors of justice for more than ten years. Today the justice system has the opportunity to prosecute genocide, a crime which is an affront to the dignity of all humanity. These events fill us with hope and motivate us to continue the fight against forgetting.

We express our satisfaction at this arrest. We hope that the authorities continue to pursue the judicial process against him, and that he will be the first to be convicted of the many responsible for genocide that remain at liberty. We will continue on the path towards justice, recuperating our history and speaking the truth.

We invite you to accompany us in this process, which is historic not only for our country, but for Latin America and the world. We will show that our justice system CAN work, and has the capacity and courage to prosecute the crime of genocide.

Hoy 17 de junio, a 29 años de haber iniciado la ejecución del Plan Victoria 82 elaborado por el Jefe del Estado Mayor del Ejército y el gobierno de facto de Efraín Ríos Montt, fue capturado en ciudad de Guatemala, el General Héctor Mario López Fuentes acusado del genocidio ocurrido contra el pueblo maya Ixil en los años 82 y 83.

Las víctimas y sobrevivientes del genocidio han tocado las puertas de la justicia desde hace más de 10 años y hoy el Sistema de Justicia tiene la oportunidad de juzgar un delito tan grave como lo es el genocidio, que lastima la dignidad de la humanidad. Este hecho nos llena de esperanza y anima a continuar luchando contra el olvido.

Manifestamos nuestra complacencia por esta captura y esperamos que las autoridades lo dejen ligado a proceso y pueda condenarse al primero, de muchos genocidas que se encuentran en libertad. Se celebra consulta comunitaria en Sacapulas, El Quiché

El 20 de mayo, 2011, en la quinta consulta comunitaria llevada a cabo en el departamento de El Quiché, 28,209 mujeres, hombres y jóvenes residentes del municipio de Sacapulas levantaron la voz* para pronunciar un retundo NO a la entrada al municipio de compañías nacionales y transnacionales con fines de explotar los recursos minerales e hídricos. La decisión histórica fue asistida por el 59.01% de la población, y el voto femenino representó el grueso de la participación adulta, mientras que el voto juveníl, por su parte, constituyó casi el 47% del total. Al nivel nacional, hasta la fecha, más de 660,000 guatemaltecas y guatemaltecos han rechazado la imposición de megaproyectos en sus territorios por medio de 61 consultas comunitarias.

La Coordinadora nació en respuesta a la preocupación popular generalizada que se generó a raíz del conocimiento público, por medio de información pública y oficial de los ministerios del gobierno, de la existencia de cinco licencias mineras sobre el territorio del municipio, así como proyectos mineros e hidroeléctricos en municipios aledaños susceptibles de aftectar la población de Sacapulas. Dichos megaproyectos fueron aprobados sin el consentimiento libre, previo e informado de las comunidades del área.

La Coordinadora habiéndose hecho cargo de llevar a la población la información pública referente a los proyectos desarrollándose sobre sus comunidades, a lo largo y a lo ancho del municipio se sostuvieron asambleas microregionales en donde se le consultó al público cómo proceder frente a la amenaza a su bienestar. En cada sector se ratificó la necesidad de llevar el debate al pleno de comunidades, y de esta manera, en una asamblea universal sostenida el 9 de abril del 2011, se decidió someter a consulta popular la cuestión de los megaproyectos extractivos en el municipio de Sacapulas.

Así como en el resto del municipio, los comunitarios de la aldea Tzununul expresaron un rotundo rechazo a las actividades extractivas de empresas nacionales y transnacionales en Sacapulas. Graham Hunt

En un acuerdo municipal emitido tras una sesión pública celebrada el 11 de mayo del 2011 (ver la parte inferior de la página), el honorable Concejo Municipal de Sacapulas, presidido por el Alcalde Municipal, el Profesor Pedro Pú Tojín, tomando en cuenta que "[s]egún copias de documentos que se tienen a la vista el día de hoy, presentadas por los miembros de la Coordinadora de comunidades en resistencia en defensa de los recursos naturales y el medio ambiente del Municipio de Sacapulas, consta que en diversas fechas la Dirección General de Minería del Ministerio de Energía y Minas recibió para su trámite solicitudes de licencias de exploración y explotación minera en la circunscripción territorial de Sacapulas, así mismo se tiene conocimiento que por parte del I.N.D.E. [(Instituto Nacional de Electrificación)] se tiene planificado construir una hidroeléctrica denominada "Serchil" sobre la rivera del río negro [sic] que atraviesa nuestro municipio," acordó "avalar el proceso de consulta comunitaria a todas las comunidades del municipio de Sacapulas del departamento del Quiché". Asimismo, en el acuerdo, el Concejo Municipal hace constar "[q]ue la Municipalidad, con el apoyo de los Alcaldes Auxiliares de todas las comunidades de Sacapulas, con fecha dos de diciembre del año dos mil nueve y ocho de diciembre de dos mil diez, presentaron dos memoriales en contra de la actividad minera".

On May 20, 2011, in the fifth community referendum carried out in the department of El Quiché, 28,209 women, men and youth in the municipality of Sacapulas raised their voice* to pronounce a resounding NO to the entry into the municipality of national and transnational companies seeking to exploit mineral and hydraulic resources. 59.09% of the population took part in the historic decision, with women making up the majority of the adult vote and youth nearly 47% of the total. At the national level, to date, more than 660,000 Guatemalans have rejected the imposition of megaprojects in their territories via more than 60 community referenda.

The process of awareness-raising that culminated in the community referendum was led by the Coordinadora de Comunidades de Sacapulas en Resistencia y en Defensa de los Recursos Naturales y Medio Ambiente (Coordinating Committee of the Communities of Sacapulas in Resistance and in Defense of Natural Resources and the Environment), a representative body made of of delegates from each microregion in the municipality. The Coordinadora was founded in response to the generalized popular concern that came into being with the popular knowledge, via public and official information from government ministries, of the existence of five mining licenses on lands belonging to the municipality, as well as mining and hydroelectric projects in neighboring municipalities likely to affect the population of Sacapulas. These megaprojects were approved without the free, prior informed consent of area communities.

The Coordinadora having taken charge of sharing with the population the public information regarding the projects being developed over their communities, microregional assemblies were carried out throughout the municipality in which the population was consulted as to how to proceed in the face of the threat to their well-being. In each sector the decision was made to elevate the discussion to a forum involving all the communities and, in this way, in a universal assembly held on April 9, 2011, the communities of Sacapulas decided to submit the issue of extractive megaprojects in the municipality to a public referendum.

As in the rest of the municipality, the population of the village of Tzununul expressed a round rejection of the extractive activities of national and transnational companies in the municipality. Graham Hunt

In a municipal accord emitted following a public session celebrated on April 11, 2011 (see the bottom section of the page), the honorable Municipal Council of Sacapulas, presided by the Municipal Mayor, Professor Pedro Pú Tojín, taking into account that "[a]ccording to copies of documents in our sight today, presented by members of the Coordinator of communities in resistance in defense of natural resources and the natural environment of the Municipality of Sacapulas, it is evident that on various dates the Office of the General Director for Mining of the Ministry of Energy and Mines received for processing requests for mining exploration and exploitation licenses in the territorial circumscription of Sacapulas; likewise, we have knowledge that on the part of the I.N.D.E. (National Institute for Electrification) there are plans for the construction of a hydroelectric plant known as "Serchil" over the banks of the Black River, which runs through our municipality," agreed to "back the process of consultation of all the communities of the municipality of Sacapulas of the Quiché department." Likewise, in the accord, the Municipal Council makes it known "[t]hat the Municipality, with the support of the Auxilliary Mayors of all the communities of Sacapulas, on the second of December of the year two-thousand nine and on the eighth of December two thousand ten, presented two declarations against mining activities."

Corte de Constitucionalidad otorga amparo, suspende reglamento de consultas comunitarias

El 23 de marzo del 2011, representantes de varios municipios que han celebrado consultas comunitarias, articulados en el Consejo de Pueblos de Occidente (CPO), interpusieron un amparo exijiendo que el gobierno desistiera en su intento por reglamentar las consultas. Graham Hunt

El 25 de abril del 2011, la Corte de Constitucionalidad de Guatemala resolvió otorgar un amparo provisional en contra del Presidente de la República, Álvaro Colóm Caballeros, así suspendiendo temporalmente el intento del gobierno central por reglamentar las consultas comunitarias en el país. El recurso de amparo fue solicitado el 23 de marzo por la representación legal de varios de los municpios que han llevado a cabo consultas comunitarias en el altiplano, articulados en el Consejo de Pueblos de Occidente. Textualmente, la resolución emitida declara que "En virtud de que, a juicio de esta Corte, las circunstancias lo hacen aconsejable, se otorga el amparo provisional solicitado; como consecuencia, se suspende en forma temporal el procedimiento que inicio [sic] el Presidente de la República -autoridad impugnada-, que tiene por objeto aprobar el proyecto de reglamento denominado "Reglamento para el proceso de consulta del Convenio 169 de la organización Internacional del Trabajo (OIT) sobre Pueblos Indígenas y Tribales en países independientes" así como la disposición por la cual el Ministro de Trabajo y Previsión Social concedió el plazo de treinta días hábiles para recibir obiniones respecto del proyecto de reglamento, que inicio [sic] a partir del veinticuatro de febrero de dos mil diez [sic]." Debe saberse que la fecha en la cual el Ministerio de Trabajo y Previsión Social abrió su despacho a la recepción de opiniones sobre el reglamento propuesto fue el 23 de febrero del 2011, y no 2010 como lo declara la resolución de la CC.

Mientras resolvió a favor del amparo, la CC resolvió en contra de una "solicitúd de ampliación" por la cual 27 individuos representantes de municipios que han llevado a cabo consultas comunitarias se habrían adherido al proceso de amparo como "terceros interesados."

En su blog, el Consejo de Pueblos de Occidente "[hace] un llamado a todos los pueblos, iglesias, sectores y organizaciones nacionales e internacionales a mantenerse vigilantes a la decisión final de la Corte de Constitucionalidad a favor de los pueblos indígenas".

Constitutional Court grants injunction, provisionally halts regulation of community referenda

On March 23, 2011, representatives of municipalities that have carried out referenda, articulated in the Consejo de Pueblos de Occidente (CPO), filed an injunction demanding that the government desist in its efforts to regulate community referenda. Graham Hunt

On April 25, 2011, Guatemala's Constitutional Court resolved to grant a provisional injunction against the President of the Republic, Álvaro Colom Caballeros, thereby temporarily suspending the central government's attempt to regulate community referenda in the country. The injunction was filed on March 23 by the legal representation of various municipalities that have carried out referenda in the Guatemalan highlands, articulated in the Consejo de Pueblos de Occidente. The resolution, in Spanish, can be found on GoogleDocs here.

Textually, the resolution emitted states that "In light of the fact that, in the judgment of this Court, the circumstances make it advisable, the provisional injunction is granted; consequentially, the process initiated by the President of the Republic--the impugned authority--which has as its object the passage into law of the regulatory project known as the 'Regulation for the process of consultation of Convention 169 of the International Labour Organization (ILO) on Indigenous and Tribal Peoples in independent countries,' as well as the disposition by which the Minister of Work and Social Welfare set a period of thirty working days for the reception of opinions regarding the mentioned regulation, which began as of the twenty-third of February, two thousand ten [sic], is suspended." It should be noted that the date on which the Ministry of Work and Social Welfare opened its dispatch to the reception of opinions over the proposed regulation was February 23, 2011, and not 2010 as stated in the CC's resolution.

While the CC resolved in favor of the injunction, it resolved against a "request for expansion" by which individuals representing 27 municipalities that have carried out community referenda would have entered the injunction process as "interested third parties."

In a blog post, the Consejo de Pueblos de Occidente "call[s] on all peoples, churches, and sectors, as well as national and international organizations, to remain watchful for the favorable decision of the Constitutional Court."

Maya Mam People Declare Mining-Free Territory

In the presence of community, municipal and ancestral authorities from Mam territory, as well as delegations from other departments, community leaders presented the "Declaration of the Mam People Free from Mining." DECLARATION OF THE MAYA MAM PEOPLE AS “FREE FROM MINING”
(Huehuetenango Region)

We, men and women, sons and daughters, granddaughters and grandsons of K'aib'il B'alam, authorities and organizations integrating the Consejo del Pueblo Maya de Occidente -CPO- and municipal authorities, gathered in our spiritual and political center Zaculew, on the day 6 Noj as marked by our ancestral calendar, [have] gathered to determine the following:

CONSIDERING:

That we are the Maya Mam people and that we have maintained our existence through time and space for thousands of years, that currently we are two million, that we have conserved our mechanisms of participation and coexistence, Zaculeu being a historic referent of our spirituality and our political center, an inheritance and patrimony that has been taken away from us and which we are reclaiming.

CONSIDERING:

That our territory has immense wealth in biological diversity and transcends borders and geographical limits imposed by the colonists starting five hundred years ago; currently, we find ourselves under threat of a new transnational invasion by which, with a discourse of “development,” national and transnational companies, in complicity with successive governments, attempt to take the natural resources that by inheritance belong to us.

CONSIDERING:

That the Guatemalan state, in complicity with national and transnational [companies], has systematically violated our collective rights by authorizing, without prior consultation and without our consent, mining exploitation licenses, the construction of hydroelectric plants and other megaprojects in our territory prioritizing the interests of national and transnational companies.

CONSIDERING:

That we, the Mam people of Colotenango, Ixtahuacan, San Sebastián Huehuetenango, Santa Barbara, San Gaspar Ixil, San Pedro Necta, Santiago Chimaltenango, San Juan Atitlan, Todos Santos Cuchumatan, San Rafael Petzal, and Cuilco, respectively, making use of our values, norms and organization, and by means of a process of dialogue and good faith community referenda, in consensus, have taken the decision to categorically reject the new transnational invasion. We have carried out our consultations using national and international legal instruments, ratified and recognized by the State of Guatemala.

CONSIDERING:

That the State of Guatemala, making use of colonial, neoliberal and bad faith mechanisms, intends to refuse recognition of the decisions we have emitted via Community Consultations, and to disqualify this legitimate process; the current government is attempting to impose upon us a regulation of community referenda that minimizes and distorts the spirit of consultations carried out within our worldview and value system.

Therefore:

In assembly and in symphony with our grandmothers and grandfathers, with total clarity regarding the struggle for our free self-determination as an original people, an inalienable right:

WE DECLARE:

We declare the territory of the Mam people “mining-free,” free from the dispossession and usurpation of our natural resources; we set forth to construct our own processes of political, social, economic and cultural redefinition, from our worldview and value system, knowledge and ancestral practices.

That we, the 12 municipalities making up the territory of the Mam People, will struggle without rest for the administration of our common well-being and will collectively defend our territory against any aggression or threat.

That we will work together in order to advance in our territorial, economic and political autonomy, for dependence has led to stagnation and the deterioration of our collective life as Maya people, and we propose that with time we will reconstruct the Mam family that has been separated by the geographical limits imposed by the colonial, neoliberal system.

We declare non gratæ the persons and institutions that lend themselves to the interests of the government and business and compromise our territories in their attempt to unilaterally regulate community referenda.

We move to recover our spiritual and political center Zaculew, which by historical right belongs to us, and for which we will not permit another attempt at intervention and plundering as has happened in the past, but more than anything we will not permit racist opinions that place in doubt its originality and its historical continuity with us, the Maya people, its grandsons and grandaughters.

The present declaration enters into effect immediately.

DECLARACION DEL PUEBLO MAM “LIBRE DE MINERIA (Región de Huehuetenango)

Nosotras y nosotros: hombres y mujeres, hijos e hijas, nietas y nietos de K´aib´il B´alam, autoridades y organizaciones comunitarias integrantes del Consejo del Pueblo Maya de Occidente –CPO- y autoridades municipales; reunidos en nuestro centro espiritual y político Zaculew, en un día 6 Noj que marca nuestro calendario ancestral, para determinar lo siguiente:

CONSIDERANDO:

Que somos Pueblo Maya Mam y nuestra existencia se ha mantenido en el tiempo y espacio desde hace miles de años, actualmente somos dos millones de habitantes, hemos conservado nuestros mecanismos de participación y convivencia; siendo Zaculeu, una referencia histórica de nuestra espiritualidad y centro político, herencia y patrimonio que se nos ha arrebatado y que en este momento lo estamos retomando políticamente.

CONSIDERANDO:

Que nuestro territorio, tiene inmensa riqueza en diversidad biológica y trasciende fronteras y límites geográficos impuestos por la colonia desde hace más de quinientos años; actualmente, nos encontramos bajo amenaza de una nueva invasión transnacional, que con el discurso del “desarrollo”, empresas nacionales y transnacionales, en complicidad con los gobiernos de turno; pretenden arrebatar nuestros bienes naturales que por herencia ancestral nos pertenecen.

CONSIDERANDO:

Que el Estado de Guatemala, en complicidad con empresas nacionales y transnacionales ha violentado sistemáticamente nuestros derechos colectivos al autorizar sin consulta previa y sin nuestro consentimiento licencias de explotación minera, construcción de hidroeléctricas y otros megaproyectos en nuestro territorio, privilegiando intereses de las empresas nacionales y transnacionales.

CONSIDERANDO:

Que el Pueblo Maya Mam de: Colotenango, Ixtahuacan, San Sebastián Huehuetenango, Santa Barbara, San Gaspar Ixil, San Pedro Necta, Santiago Chimaltenango, San Juan Atitlan, Todos Santos Cuchumatan, San Rafael Petzal, Cuilco, respectivamente; haciendo uso de nuestros valores, normas, organización y mediante el proceso de diálogo y consultas comunitarias de buena fe, en consenso, hemos tomamos la decisión de rechazar categóricamente la nueva invasión transnacional; nuestras consultas se realizaron utilizando los instrumentos legales nacionales e internacionales, aprobados y reconocidos por el Estado de Guatemala.

CONSIDERANDO:

Que el Estado de Guatemala, haciendo uso de mecanismos de tinte colonial, neoliberal y de mala fe, pretende desconocer nuestras decisiones emitidas en las Consultas Comunitarias; y para descalificar este proceso legítimo, el gobierno actual pretende imponernos un reglamento de consulta que minimiza y tergiversa el espíritu de consultas, desde nuestra cosmovisión.

Por tanto:

En asamblea general y en sintonía con nuestras abuelas y abuelos, con plena claridad política hacia la búsqueda de nuestra libre determinación como pueblo originario, es un derecho irrenunciable;

ACORDAMOS:

Declaramos el territorio Mam “Libre de Minería”, libre del despojo y usurpación de nuestros bienes naturales; nos proponemos a construir nuestros propios procesos de replanteamiento político, social, económico y cultural, desde nuestra cosmovisión, conocimientos y práctica ancestral.

Que lucharemos incansablemente los 12 municipios que conformamos el territorio Mam, para gestionar nuestro bienestar común y defender nuestro territorio en forma colectiva, ante cualquier agresión y amenaza que altere la integridad de nuestro territorio.

Que trabajaremos conjuntamente para ir avanzando hacia nuestra autonomía territorial, económica y política, ya que la dependencia ha ocasionado estancamiento y deterioro a nuestra vida colectiva como pueblos Mayas, y que en el futuro mediato reconstruyamos la familia Mam separada por los límites geográficos impuestos por el sistema colonial, neoliberal.

Declaramos no “gratos” a las personas e instituciones que se prestan al juego y a los intereses del gobierno y los empresarios al pretender reglamentar unilateralmente las consultas comunitarias y comprometen nuestros territorios.

Nos proponemos recuperar nuestro centro espiritual y político Zaculew, que por derecho histórico nos pertenece, por lo que no permitiremos otro intento de intervención y saqueo como lo hicieron en años anteriores, pero sobre todo opiniones racistas que pongan en duda su originalidad y continuidad histórica con el pueblo maya que somos sus nietos y nietas.

La presente Declaración entra en vigencia inmediatamente.

Dado en nuestro centro espiritual y político Zaculew a los 18 días del mes de mayo de 2011.

Dando clausura a la Conferencia de Solidaridad con Latinoamérica en Washington, D.C., activistas participaron en la marcha de SOA Watch a la Casa Blanca, con la demanda de cerrar la Escuela de las Américas-Instituto de Cooperación para la Seguridad Hemisférica (SOA-WHINSEC, por sus siglas en inglés).
